Conditions applicables aux cartes cadeaux au Mexique
Last updated on August 15, 2022
These Mexico Gift Card Terms and Conditions (“Gift Card Terms”) govern the use of Airbnb Gift Cards ("Gift Cards") on the Airbnb Platform. Use of Gift Cards and the services available through the Airbnb Platform are subject to Airbnb's Terms of Service ("Terms"). If an undefined term appears in these Gift Card Terms, it will have the same definition as in the Terms. By using any Gift Card, you agree to these Gift Card Terms.
Redeem a gift card.
You must have an Airbnb account to use a Gift Card. You can add a Gift Card to your Airbnb account by visiting airbnb.mx/regalo. When you add a Gift Card, the full value of the Gift Card will show in your Airbnb account as your Gift Card balance. Gift Card balance may only be used to purchase available services provided through Airbnb Ireland UC and its affiliates using the Airbnb Platform. Any booking you make with a Gift Card on the Airbnb Platform will be deducted from your Gift Card balance, and any unused Gift Card balance will remain in your Airbnb account until used. If a purchase exceeds the existing Gift Card balance available in your account, the remaining amount due must be paid with another Payment Method. To check your available Gift Card balance, you must be logged into your Airbnb account.
Gift Cards are not subject to any commission. Also, Gift Cards and balances do not expire. These Gift Card Terms will apply until you have exhausted the Gift Card balance.
Limitations.
Gift Cards purchased in Mexico can only be used by individuals residing in Mexico. You must also have a valid payment method issued in the country where you reside.
Gift Cards may not be used (i) outside the Airbnb Platform, (ii) to cover expenses arising from alterations or modifications to existing services, (iii) to purchase other Gift Cards, (iv) to obtain other goods or services other than those services available on the Airbnb Platform, or (v) to send, transfer, receive, or otherwise obtain cash, electronic payment funds, or virtual assets.
Gift Cards may not be reloaded, resold, transferred for compensation, or redeemed for cash or legal tender domestically or in any other jurisdiction, except as required by law. Once a Gift Card is added to an Airbnb account, its value cannot be transferred to another person or to another Airbnb account. Additionally, the balance of a Gift Card associated with one Airbnb account cannot be transferred to another account or redeemed for cash.
Likewise, the Gift Cards do not generate any type of interest and do not represent, or cannot be considered by the User as, in any way (i) legal tender, (ii) electronic payment funds, (iii) means of disposal; (v) deposits of any nature, or (vi) virtual assets.
Risk of Loss.
Once a digital Gift Card is electronically transmitted to the purchaser or designated recipient, or a physical Gift Card is delivered to the purchaser or designated recipient, as applicable, the risk of loss and title to the Gift Card pass to the purchaser or the designated recipient. Airbnb assumes no responsibility for the loss, theft, destruction, or unauthorized use of a Gift Card.
Illicit Activities.
You expressly acknowledge that Airbnb reserves the right to take any action, including refusal to issue or accept a Gift Card, in the event of suspected fraud or any other illegal or prohibited conduct. Airbnb has the right to close or suspend a Member’s account and charge an alternative Payment Method if a Gift Card obtained in a fraudulent, unlawful or prohibited manner is redeemed and/or used to make payments on the Airbnb Platform.
Limitation of Liability.
We make no warranties, express or implied, with respect to Gift Cards. In the event a Gift Card is non-functional, your sole remedy, and our sole liability, will be the replacement of such Gift Card.
Termination; Waiver.
Your rights under the Gift Card will terminate if you breach these Gift Card Terms in any way and/or if your Airbnb account is terminated or is suspended for any reason. Upon termination, you must discontinue use of the Gift Card and you acknowledge that we may, without liability, revoke your access to the Gift Card balance you have accumulated to date. Airbnb's failure to enforce these Gift Card Terms and/or the Terms will not constitute a waiver of those rights.
Disputes.
Any dispute or claim relating in any way to Gift Cards will be resolved in accordance with the Dispute Resolution, Jurisdiction and Forum, and Applicable Law for the Rest of the World section of the Terms.
