Terms and Conditions of Rental


This Rental Agreement and Contract (the “Agreement”) is a legally binding agreement made and entered into as of the Reservation Date written below by and between the undersigned person(s) or company (the “Renter”) and the undersigned owner, manager or agent (“Owner”), pursuant to which the Renter has agreed to rent the residence described below (the “Property”), for the duration of the Rental Term for the Total Rental Fee and other good and valuable consideration as described herein.

These Terms and Conditions clarify The Owner's obligations to The Renter, The Renter's obligations to The Owner, and in the very unlikely event of any disputes, will be used as the basis for any resolution. Please read them carefully before confirming your booking.

Acceptance of these Terms & Conditions binds a contract between the following two parties for the rental of the Property (________________________________):

The Renter Applicant (___________) and The Owner (____________)

1. Party Members

All persons listed on the Rental Agreement or added subsequently by The Owner will be bound by the terms of this agreement. Occupancy of the property is restricted to those names listed on the Agreement or added subsequently by The Renter. The Renter Applicant is considered to be the Lead Renter and will assume full responsibility for all members of the Rental Group throughout the rental period. Information or instructions relating to this rental will be communicated to the Renter Applicant only and not to any third-party member of the Rental Group.

2. Payments

All payments and refunds will be made through www.airbnb.com following Airbnb terms and conditions.

3. Cancellation Policy & Changing a Booking

Once a reservation has been accepted and confirmed, a cancellation can only be made in accordance with the terms below:

4. Occupancy of the Property

Regardless of the published maximum number of persons a property can accommodate, the number of guests occupying the Property is strictly limited to those named on the Rental Agreement or any subsequent amendment notified in writing to The Owner. The stated and agreed occupancy figure includes all persons irrespective of age, day and overnight guests.

Exceeding the number of stated and agreed persons will result in immediate eviction without refund, or a $75.00 per guest per night charge at the discretion of The Owner.

5. Condition of the Property

The Property is provided in “as is” condition. The Owner shall use its best efforts to ensure the operation of all amenities in the Property, such as satellite or cable TV access as applicable. The Owner shall not be held responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible. The Renter acknowledges that use of amenities such as pools, decks, grills, appliances and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Renter’s own risk.

Renter shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. Renter and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall The Renter use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property.

The Property will have been inspected prior to occupation and therefore The Renter undertakes to:

-Notify The Owner immediately with regard to any damage and/or maintenance issues that require attention.

-Keep the Property and all furniture, fixtures, fittings, chattels and effects in or about the Property in the same state of repair and condition as found at the commencement of the Rental.

-The Renter shall leave the Property in the same state of cleanliness and general order in which it was found. Failure to do so to the satisfaction of The Owner will result in a damage/cleaning charge being levied.

-Any damage to the Property, the equipment included on the Property or to the communal facilities and premises made by the Renter, Party Members or his/hers guest will be paid by the Renter. Payment should be made in such a manner that the damage item may be restored to its original condition or substituted by a new item of equal or greater quality than the original.

7. Pets

Pets are strictly prohibited at this property. Any evidence of pet occupation will result in a forfeit of the damage deposit in its entirety.

The Owner accepts no responsibility for any allergic reaction or other conditions arising from occupancy of the property. The designation of “No Pets” does not indicate there have not been pets at the property at some time.

8. Smoking

Smoking is not permitted in or around the immediate vicinity of the Property. Any evidence of smoking on the Property will result in a forfeit of the damage deposit in its entirety.

10. Equipment and Facilities Provided

Equipment and facilities are provided at the discretion of The Owner and whilst every attempt is made to ensure that such equipment is in working order for the duration of the rental period, should a breakdown or some other situation occur that renders non-essential element unusable,

the Owner does not take responsibility for replacing or refunding The Renter for the lack of use of these equipment or facilities. The equipment and facilities referred to include (but are not exclusive to) such items as TV, electrical water heater, air conditioner and ceiling fans.

The Renter must report any inoperative or defective equipment to The Owner promptly! The Owner will make every reasonable effort to have repairs made as soon as possible; however, there are limited service contractors in Boquerón. While every attempt will be made to ensure that all the advertised equipment and appliances are in working order at the commencement of a rental period, no reduction of rent; rebate; or refund will be issued for a mechanical failure of air conditioning, TV or other appliances.

The Renter will provide one set of keys for all exit doors on the Property, for the door accessing the open terrace and for the pedestrian gate accessing the building complex. The Renter will provide also two beepers to control the vehicular gate of the building complex. On check-out the Renter will return to the Owner the complete set of keys and the two beepers provided to the Renter by the Owner. Loss or damage by the Renter of the set of keys or beepers will result in a charge to the Renter of $100.00 for every item lost or damaged.

11. Refunds

If a breakdown should occur to fundamental elements such as water systems, plumbing and electrical systems, and major appliances such as stove or refrigerator, every effort will be made to repair or replace, or an appropriate refund will be made for the inconvenience caused. This does not apply to system breakdown caused by misuse, such as plumbing blockages caused by inappropriate use of sanitary facilities.

The Owner is not liable, nor will provide a refund, for any stoppage of electrical services caused by any circumstances beyond his control. Similarly, there will be no refunds for inclement weather, changes in water levels, conditions at neighboring properties, or any nuisance afforded by the natural elements of the location such as flying insects or the animal population.

12. Other Conditions of Booking

The Renter shall abide by these Terms and Conditions of Rental and any other instructions provided by Airbnb and any additional information and instructions as shall be supplied in the Property or by The Owner.

RISK OF LOSS AND INDEMNIFICATION: The Renter agrees that all personal property, furnishings, personal affects and other items brought into the Property by The Renter or their permitted guests and visitors shall be at the sole risk of The Renter with regard to any theft, damage, destruction or other loss and The Owner shall not be responsible or liable for any reason whatsoever.

The Renter hereby covenants and agrees to indemnify and hold harmless The Owner and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorneys fees incurred by The Renter, permitted guests, visitors or agents, representatives or successors of The Renter due to any claims relating to destruction of property or injury to persons or loss of life sustained by The Renter or family and visitors of The Renter in or about the Property and The Renter expressly agrees to save and hold The Owner harmless in all such cases. Further, he/she accepts full responsibility for the use of the Property and any communal facilities (such as the communal pool and gazebo) and agrees to pay for any damage to the Property, communal facilities and its equipment, other than for normal wear and tear. There is and will not be lifeguard on duty on the communal pool at any time. The Renter acknowledges the risks involved on using the pool facilities without a lifeguard on duty and agrees to use at his/hers own risk. The Renter and his/hers guests will follow at all times the safety rules posted on pool premises.

RELEASE The Renter hereby waives and releases any claims against The Owner, the Property owner and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by The Renter on or near or adjacent to the Property, including any common facilities, activities or amenities. The Renter agrees to use any such facilities or amenities entirely at the Renter’s own initiative, risk and responsibility.


ENTRY AND INSPECTION The Owner reserves the right to enter the Property at reasonable times and with reasonable advance notice for the purposes of inspecting the Property or showing the Property to prospective purchasers, renters or other authorized persons. If The Owner has a reasonable belief that there is imminent danger to any person or property, The Onwer may enter the Property without advance notice.

GENERAL PROVISIONS This Agreement contains the entire agreement between the parties with regard to the rental of the Property, and any changes, amendments or modifications hereof shall be void unless the same are in writing and signed by both the Renter and The Owner. This Agreement shall be governed by the laws of the Commonwealth of Puerto Rico . The words “The Owner” and “Renter” shall include their respective heirs, successors, representatives. The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waver of that or any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the Agreement shall not be affected. Any notice required to be given under this Agreement shall be in writing and sent to the contact information included herein. This Agreement may be signed in one or more counterparts, each of which is an original, but taken together constitute one in the same instrument.

The description wasn't as accurate as it should because the place wasn't as clean as we thought it would be. We had to take and leave the keys in Mayagüez, not in the place...

The condo was very large and spacious. The first floor had an open plan with a bar counter next to the living room. The second floor had an open room that was furnished with a bed and a futon sofa. There was a bathroom and then the master bedroom with a queen bed. The third floor was a small bathroom and outdoor rooftop deck. The location was great for Combate (URL HIDDEN) was literally a three block walk to the beach. We were there over Easter, so Combate Beach was a huge party atmosphere. You definitely need a car to get around to other beaches and restaurants. Amaury was wonderful...we missed our connection in Houston due to a blizzard in Denver, so we were 9 hours late arriving. He met us at midnight to give us the keys and gate opener. Very prompt at texting and he was very patient with our rudimentary Spanish texts! The main drawback with this condo is the lack of a/c. It was extremely hot, so we all slept together in the master bedroom so we could all enjoy the a/c. It was a large condo but we pretty much stayed in the one room the whole time. The rest of the large space was unused. It would have been nice to have wifi as well.

Gilberto was quick to respond and Amaury handled key/gate entry exchange and were great in accommodating our last minute booking needs. His place was clean and as described on the listing. Excellent location a minute from Combate beach by car and a little over 10 minutes to Playuela. The place had everything we needed for our short stay and we thoroughly enjoyed the area.

I believe it is easy to find the greatest joys of life on the simplest of ways. I found this to be specially true on our last travel (that is my wife and I) to Curacao. Although Willemstad is beautiful our greatest experience was outside the traditional tourist areas and destinations. Thanks to a friend we found in Curacao we were able to explore the island getting a true feeling of Curacao's ways (its people, music, food, etc). After our first stop on a small bar / grocery store on the rural area the tourist inside us vanished and the traveler began to flourish. As travelers wanting to explore we found the best beaches, landscapes and typical meals that the locals (with all their wisdom) have reserved for themselves and for travelers that dare to explore.

Then, back into my beloved island (Puerto Rico), I found we do the same ;-). Getting outside the beautiful, but crowded, capital (San Juan) there is so much more. But I really mean it, so much more. The locals know it and that is why the west side of the island is the preferred destination among the locals. In this area you will find the best beaches on Puerto Rico (like Combate Beach and La Playuela Beach) with clear and calm waters ideal for children, families and anyone not interested on fighting strong waves to relax on the beach. Also you can find great dining venues international and local eateries at affordable prices.

I honestly can say this is my favorite place in Puerto Rico. I come here every weekend to relax, enjoying beautiful landscape and wildlife inside the wildlife refuge, hiking, mountain biking or simply laying down on the sand outside any crowded city. My wife and I fell in love watching the sunsets on the spectacular cliffs at the Cabo Rojo's Lighthouse. This place is a real treasure for us that we hold close and dear.

I really hope you can come to visit us at Camino del Mar Townhouse during your travel. We'll put all our efforts to make the best of your stay with us.
