Enjoy the ease and economy of flying into Phoenix Sky Harbor International Airport and your short drive northeast up the Beeline Highway to our beautiful retreat. Located on a private, yet convenient cul-de-sac, just minutes from Mayo Clinic, Ft. McDowell and some of Arizona’s premier golf courses and shopping/dining experiences, the contemporary, open floor plan with high ceilings provides the perfect spot to sit by the Mini-Pebble heated pool or entertain friends with the 60” Plasma TV and wet bar or the 65” DLP TV and Brunswick pool table. Gather around the high-top table to enjoy a game of cards, or relax with a movie from our large DVD library. For the music enthusiasts, enjoy our vast CD collection or better yet, if there’s a pianist in the group, let them serenade you on the beautiful ivory baby grand piano. Enjoy the beautiful summer nights on the 600+ square feet of covered patio or sit in the spacious Sundance Maxxus Spa and make a wish on the beautiful starry skies above Fountain Hills, a wonderful community centered around its world famous fountain, where street lights are the exception and quiet relaxation is the rule.

Enjoy the gourmet kitchen complete with premium appliances, custom cabinetry and exquisite Verde Bamboo slab granite countertops with full backsplash. DAMAGE DEPOSIT –The deposit is NOT applied toward rent; however, it is fully refundable, provided the following provisions are met.
•No damage is done to this home or its contents, beyond normal wear and tear.
•No charges are incurred due to contraband, smoking, pets or collection of rents or services rendered during the stay.
•All (tenants only) debris, rubbish and discards are placed in the provided receptacles
•Soiled dishes are placed in the dishwasher and cleaned.
•All used linens and towels are placed in laundry room on the floor.
•All garage, TV, DVD/CD remote controls are left on the kitchen table and Home is leftlocked and the keys are placed back in the lockbox.
•All charges incurred and accrued during the stay are paid prior to departure.
•No linens or bedding are lost or damaged
•No items are lost, damaged, or removed from the home.
•The Tenant is not arrested or fined by local law enforcement or removed/evicted by security people or the owner/owner’s representative.

1. The Landlord shall have reasonable right to inspect the premises without prior notice at any time to enforce the terms of this agreement. Should the Tenants violate any of the terms of this agreement, the rental period shall be terminated immediately. The Tenants waive all rights to process if they fail to vacate the premises upon termination of the rental period. The Tenants shall vacate the premises at the expiration time and date of this agreement.
2. NO DAILY HOUSEKEEPING SERVICE IS PROVIDED – While linens and bath towels are included, daily maid service is not included in the rental rate. We do not permit towels, linens, or ANY linens to be taken from the home.
3. The Tenants shall maintain the premises in a good, clean, and ready to rent same good and habitable condition, and use the premises and its contents only in a careful and lawful manner. The tenants shall leave the premises in a ready to rent condition at the expiration of the rental agreement, defined by the Landlord as being immediately habitable by the next tenants. (We ask that you do a basic cleaning as our cleaning people come in and do a thorough cleaning & sanitizing of all surfaces including all cabinets and knobs.) Tenants shall pay for maintenance and repairs should the premises be left in a lesser condition. The Tenants agree that the Landlord shall deduct costs of said services from the security deposit prior to refund if Tenants cause damage to the premises or its furnishings.
4. The Tenants shall dispose of all waste material generated during the rental period in a lawful manner and put the trash in containers, stored in the garage. Place only recyclable material into the separate recycle (*blue lid) container. Pickups are Thursday mornings prior to 7:00 AM. Tenant is cautioned not to leave garage doors open for long periods of time as it attracts uninvited animals.
5. The Tenants shall pay for any damage done to the premises over and above the security deposit amount.
6. No animals or pets of any kind will be brought onto the premises, without prior written consent of the Landlord.
7. The Tenant shall not sublet the property and shall be the responsible party in attendance at check-in. Tenants or their guests will not contact/disturb the neighbors to
secure directions or any other information or disclose any of the confidential information contained in this rental agreement, including but not limited to rates, names or numbers of people in the renting party.
8. The Tenants may park one (1) car inside the garage. The garage doors should be closed at all times.
9. The Tenants shall behave in a civilized manner and maintain a reasonable speed limit in and out of the property and shall be good neighbors respecting the rights of the surrounding property owners. The Tenants shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement and Tenants shall then immediately vacate the premises; tenant then waives all rights for any refund.
10. Quiet hour starts at 10 PM through 8 AM!! Hot tub, pool, and outdoor noise should be kept to a minimum. Excess noise is defined as…Any sound that is plainly audible for one (1) minute or longer at a distant distance of 25 feet or more when measured from the source property line between the hours of 10 PM and 8 AM daily is subject to a $250 spot fine, second violation is a $500 spot fine, third violation, immediate removal from the property. Noise carries... please be a good neighbor. Do not hesitate to contact the owner with any concerns11. There shall be no smoking within the structure, including within the garage.
12. Landlord shall provide towels, linens, cups, knives, forks, spoons, dishes, toilet paper, soap, dish detergent, laundry soap and other items as commonly used by the Landlord’s family. Shampoos, and other consumables are to be purchased by the Tenant. No reimbursement will be made for unused consumables left at the premises. If consumables exist at the premises when the Tenant, arrives the Tenant is free to use them.
13. The Tenants and Tenants' Guests (8 maximum) shall hereby indemnify and hold harmless the Landlord against any and all claims of personal injury or property damage or loss arising from use of the premises, regardless of the nature of the accident, injury or loss, including errant golf balls from the adjoining course. The property may not be used as a party/gathering place for off premise guests without Landlords express written permission. Any reservation obtained under false pretense will be subject to forfeiture of all advance payments or deposits, and the party will not be permitted to check in. Tenants expressly recognize that any insurance for property damage or loss, which the Landlord may maintain on the property, does not cover the personal property of Tenants, and that Tenants should purchase their own insurance for Tenants and Guests if such coverage is desired.
14. Tenant agrees not to change thermostat schedule. Doors and windows shall be closed when heat, or air-conditioning, is in operation.
15. Tenant agrees not to access the “owner’s closets” or garage/storage closets, even if unlocked, which contain cleaning supplies, chemicals and equipment that could be hazardous to children and adults.
16. Tenants expressly acknowledge and agree that this Agreement is for transient occupancy of the Property, and that Tenants do not intend to make the property a residence or household.
17. We occasionally experience outages that are beyond our control. We report outages as each occurs. No refunds or compensation will be given for any outages.
18. There shall be no refunds of rents due to shortened stays or ruined expectations because of weather conditions.
19. CANCELLATIONS - A ninety (90) day notice is required by either party for cancellation. Cancellations that are made more than ninety (90) days prior to the arrival date will incur no penalty. Cancellations or changes that result in a shortened stay, that are made within ninety (90) days of the arrival date, forfeit the full advance payment and reservation deposit. Cancellation or early departure does not warrant any refund of rent. Under no circumstances shall the Owner be liable to Tenant or any other party for any indirect, special or consequential damages of any character related to this agreement and in no event will Owner be liable for any damages in excess of the amounts actually paid by Tenant to Owners in connection with this agreement.
20. There shall be no refunds of rents because of shortened stays or ruined expectations due to work and family emergencies or other commitments.
21. It is the tenant’s responsibility to learn about safety precautions, warning signs of water conditions, and safety procedures concerning the pool and hot tub. Tenant agrees to have a responsible adult supervising minors while they are in the pool and hot tub. Tenant is hereby notified that the pool and hot tub can be dangerous and tenant accepts fully the risks involved. DO NOT STAND ON THE HOT TUB COVER!!! The hot tub cover is for insulation purposes and is not designed to support a person or persons -- it will break and you may be charged for replacement. Remember, when not using the hot tub, please leave the cover on so the hot tub will stay warm.
22. Only legally owned and permitted firearms shall be allowed on the premises according to State and local laws.
23. Tenant agrees that fireworks and other hazardous materials shall not be used in or around the property.
24. Tenant shall use the property for legal purposes only and any other use, including but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc.; shall cause termination of this agreement with no refund of rents or deposits.
25. Tenant agrees to submit to Arizona Statutes and pay all reasonable costs, attorney's fees and all expenses that shall be made or incurred by Landlord enforcing this agreement. Tenant shall be responsible for any and all fines or penalties incurred by the landlord as a result of tenant's or his guests actions and shall reimburse landlord in full for any costs incurred including attorney fees. No agreements shall be verbal in nature. Only agreements that are in writing and incorporated into this document shall be legally binding.
26. Tenant is advised that the property contains wood fireplace and gas grill, and will seek help from management if the proper operation of such items is not fully understood.
27. The property has a fire extinguisher installed near the kitchen area. The fire extinguisher was fully charged at last inspection. It is the duty of the tenant to inform management immediately should the fire extinguisher become less than fully charged. Tenant agrees to use the fire extinguisher only for true emergencies.
28. The property has fire alarms installed and they are believed to function properly at the time of rental. Tenant will notify management without delay if a fire alarm “chirps” or has a low battery condition.
29. Tenant shall see to their own security while in the property by locking doors, windows, garage doors, gates, etc. and always lock all when leaving the property.
30. Valuable items left behind by tenant will be held for the tenant and every reasonable effort will be made to contact the tenant for return. If items are not claimed for longer than 3 months they shall become the property of the Landlord. The Landlord shall not be held liable for condition of said items.
31. DirectTV is provided and the Landlord has chosen service level. No refund of rents shall be given for outages, content, lack of content, or personal preferences with regard to DirectTV service. Any charges incurred while in the property, including but not limited to Pay-Per-View movies, shall be the sole responsibility of the Tenant and the Landlord shall have the explicit right to recover said charges.
32. High-speed Wireless Internet is provided as a convenience only and is not integral to the agreement. No refund of rents shall be given for outages, content, lack of content, speed, access problems, lack of knowledge of use, or personal preferences with regard to Internet service.
33. Tenant leasing the premise shall be at least 30 years of age and provide a legible photocopy of their current drivers license, a primary and secondary cell phone number for contact purposes while at the property. The laws of Arizona shall govern this agreement and rental, all parties to this agreement agree to submit to jurisdiction in Arizona regarding any dispute and that venue shall lie in Maricopa County, Arizona.
34. Absolutely NO SWIMMING while the solar cover is on the pool!! The pool is heated (when expressly included), to the best of the Landlord’s ability, with a heat pump and solar cover, but Tenants understand the temperature of the pool is dependent upon weather conditions and outside temperature. PLEASE DO NOT REMOVE the pool vacuum from the pool … it will burn up the pump!!!!
**NOTE: Tenants solely responsible for safety of children and solely responsible for the children’s access to the swimming pool and hot tub.
35. Landlord to hold tenant harmless for damage from errant golf balls from adjoining course.
