We ensure you have everything you need for enjoying all of the activities Chatham has to offer before your arrival at the ocean front house. We will provide linens, towels, and beach towels for up to 12 guests and will be happy to help plan your stay and make sure you have everything you need to explore Cape Cod and participate in all of Chatham's local activities! We welcome emails, texts or phone calls, while respecting our guests' privacy during their stay.

Quiet and peaceful, within walking distance of everything. The back yard overlooks the ocean harbor and is perfect for relaxing or entertaining after a day at the beach. Use the outdoor shower and have a cookout on the gas grill with your friends or family. There are plenty of beach toys, indoor toys and outdoor toys for every member of your family. Beach chairs, coolers, beach carts, beach umbrellas and other gear are provided.

You can easily walk to many local activities such as Chatham Village and Lighthouse Beach but will need a car to enjoy the outer areas in Chatham or other cape towns.

Thank you for planning your vacation at 4 Homestead Lane East in Chatham. We appreciate your consideration, and we’re sure you’ll have a wonderful stay! Please read the enclosed lease carefully as booking with Air BNB confirms that you're accepting the terms of the rental agreement.

This rental home includes linens, towels, and beach towels.

1. Keith and Linda Birkhaeuser agree to lease to our AirBNB Guest,
(hereafter called "TENANT"), the LEASED PREMISES known as 4 Homestead Lane East, located at 4 Homestead Lane East in Chatham, MA 02633.

2. The Lease shall be for the amount of days indicated with the booking. Check in time is at 3pm and check out time is at 10am. If the home isn't rented immediately surrounding your arrival and departure dates, your arrival time and departure time can be more flexible and the rental terms would apply to your extended hours.

3. Rental Fee: TENANT agrees to pay the Total Rental Fee confirmed by AirBNB with your booking.

4. Damage Waiver/Security Deposit: TENANT agrees to pay the $50 non-refundable Damage Waiver fee which is already included in the total rental fee amount to cover incidental damage up to a total damage value of $500. If there is more than $500 of damage to the house or property caused by the guest, the cost to repair or replace the items will be paid by the tenant.

5. TENANT agrees that no more than 14 PEOPLE and 6 CARS shall be permitted on the Leased Premises at any time during the lease term. Please note that there is no on-street parking in the neighborhood and all cars must be parked in the driveway or in the garage. TENANT and their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall TENANT use the Leased Premises for any immoral, offensive or unlawful purposes, nor violate any law or ordinance, nor commit waste or nuisance on or about the Leased Premises.

6.Initial and Final Payments: This Agreement and Reservation Confirmation must be signed and returned asap. If it is not returned, TENANT’s reservation may be canceled at the sole option of the LANDLORD. Cleaning fees are included.

7.Cancellation: Once a reservation has been confirmed by payment and TENANT is unable to fulfill obligation to occupy Rental property, the LANDLORD must be notified as soon as possible and in writing for the TENANT’s protection. The LANDLORD will make every attempt to re-rent the property once notification of cancellation has been received. If the LANDLORD is unable to re-rent the property, no refunds will be issued. If the Property is re-rented at full Rental Rate, TENANT will receive a refund of the full amount of rent tendered by TENANT, less a 15% Cancellation Fee.

8. TENANT shall keep the Leased Premises in a clean condition and shall leave the Leased Premises in the same general condition as found upon entry, including all pipes, wires, glass, plumbing and other equipment and fixtures. TENANT shall be responsible for the proper storage and the final collection or ultimate disposal of all garbage. Trash bins are provided and trash pickup is twice weekly.

9.Repairs – Service Calls – Refunds: TENANT agrees to rent property as is. There will be no refunds or relocation if TENANT is disappointed with the Rental Property. This property is unique and privately owned. The LANDLORD will make every reasonable effort to assure that the Rental property is in acceptable condition in regards to cleanliness and repair. TENANT is required to inform LANDLORD of any visible damage or unacceptable cleanliness upon check-in within 24 hours of occupancy. The LANDLORD will make every effort to make any necessary repairs in a timely manner. No refunds or rate adjustments will be provided due to inoperable appliances, equipment, air conditioning, or mechanical failure of non-essential items such as TV, cable, washer/dryer, dishwasher, etc. Please report any inoperative equipment to the LANDLORD immediately. The LANDLORD will make every reasonable effort to have repairs done quickly and efficiently. Should a repair person be called to the Rental Property and find the equipment in working order or the problem was due to oversight or neglect, the charge for service will be the TENANT’s responsibility. Also, no refunds will be given due to early departure, delayed arrival, reducing the number of nights, unfavorable weather, power blackouts, water shortage, flooding, or evacuation of the area due to hurricanes or potentially dangerous situations. TENANT’s reservation and signed Rental Agreement bind TENANT to this specific Rental Property for a specific period of time.


10.Indemnification and Hold Harmless: TENANT agrees to indemnify and hold harmless LANDLORD from and against liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with TENANT’s use and occupancy of the Rental Property including, but not limited to, any claim or liability for personal injury or damage or theft of property which is made, incurred, or sustained by TENANT(s) and their guests.

11.Occupancy Requirements, House Parties, Right of Entry, Parking: TENANT and TENANT’s family shall not exceed the published occupancy and parking capacities of the Rental Property. On street parking is not permitted in this neighborhood. The parking capacity in the driveway is six cars maximum. Four cars can fit in the driveway, although parking will be tight. Two smaller cars will fit in the two car garage. Overcrowding is not permitted. In no event shall TENANT assign or sublet the Rental Property in whole or in part. Violations of these rules are grounds for expedited eviction with no refund of any kind. TENANT hereby acknowledges and grants specific permission to the LANDLORD to enter the premises at any time for inspection purposes should the owner reasonably believe that the TENANT is causing any damage to the Rental Property. TENANT further agrees to grant the LANDLORD access to Rental Property for maintenance and repairs.

12.Pets: No animals or pets of any kind are allowed on premises unless specifically authorized by LANDLORD. The Damage Deposit Waiver does not cover any damage or flea infestation caused by a pet. Any undeclared pets found in or about the “no pet” property is grounds for immediate eviction and/or forfeiture of all monies paid and a non-declared pet charge of $200 per pet per day or any portion thereof at the LANDLORD’s sole discretion.

13.Smoking: Smoking is strictly prohibited inside the Rental Property. TENANT will incur an additional security deposit/damage waiver charge for additional cleaning and deodorizing if any evidence of smoking is found in the Rental Property.

14.Abuse of plumbing: Clogging of toilets will be the responsibility of the TENANT. There is no garbage disposal on this property and any clogged pipes or damage to pipes caused by TENANT misuse will be billed to the TENANT’s credit card on file or deducted from TENANT’s security deposit.

15.Telephone: Long distance calls should not be charged to the phone number of the telephone located within the Rental Property and are the sole responsibility of the TENANT. Any phone charges will be billed to TENANT or TENANT’s credit card on file and TENANT hereby authorizes a charge to the credit card on file for any telephone charges incurred in violation of this paragraph.

16.Check-in and Check-out Policies/Cleaning Service: The TENANT’s legal right to the use of the property does not begin until after the check-in time, and ends promptly at the check-out time. TENANT is required to leave the Rental Property in the same general condition it was when TENANT arrived. Check In and Check Out times are not flexible and overstaying Check Out time may result in additional rent in the amount of $25.00 per half hour. An inspector will inspect the Rental Property after TENANT departure to insure that the Rental Property is in good order, tidy, and damage-free. If, during the inspection, the inspector finds the rental property to be in an excessively unclean condition, or if the Check-Out Procedures are not met, a minimum of $25.00 will be retained from the TENANT’s Security Deposit or billed to the TENANT’s credit card.

17.Governing Law: This Agreement shall be enforced under the laws of the Commonwealth of Massachusetts and represents the entire Agreement. Any amendments must be in writing and signed by both parties. In the event of a dispute, legal action may only be instituted in Barnstable County, where the rental property is located. The LANDLORD shall conduct all activities in regard to this Agreement without respect to the race, color, religion, sex, national origin, handicap, or familial status of any TENANT.

18. Linens are included and the LANDLORD will provide bed linens, bath towels, beach towels, hand towels, wash cloths and kitchen towels for the TENANT’S use throughout the rental time period.

19.We do our best to provide paper products for your stay, however, if they are used up more quickly than expected, TENANT acknowledges that they must furnish their own paper products during their rental period.

20. TENANT agrees to accept the Leased Premises as is, upon arrival, provided it meets the basic standards of habitability under Massachusetts law. TENANT acknowledges that he has had the opportunity to inspect the Leased Premises prior to executing this Lease Agreement. TENANT agrees that he shall not be entitled to a refund of any Rental Fee except as provided in paragraph entitled, “Cancellation.” above.

21. TENANT understands and agrees that it shall be TENANT'S own obligation to insure TENANT'S personal property.

22. LANDLORD and TENANT state and agree that the rental of the Leased Premises is for a vacation or recreational purpose as expressed in Massachusetts General Laws C. 186, Section 15B (9).

23. The damage waiver forms, attached hereto are incorporated herein by reference.

24. The words "LANDLORD" and "TENANT" as used in this Lease Agreement shall include their respective heirs, successors, personal representatives and assigns. The words "he", "his", and "him", where applicable shall apply to LANDLORD or TENANT regardless of sex, number, corporate entity, trust or other body. If more than one party signs as LANDLORD or TENANT hereunder, the conditions and agreements herein of LANDLORD or TENANT shall be joint and several obligations of each such party.

25. The waiver of one breach of any term, condition, covenant, obligation, or agreement of this Lease Agreement shall not be considered to be a waiver of that or any other term, condition, covenant, obligation, or agreement or of any subsequent breach thereof.

26. If any provision of this Lease Agreement or portion of such provision or the application thereof to any person or circumstance is held invalid, the remainder of the Lease Agreement (or the remainder of such provision) and the application thereof to other persons or circumstances shall not be affected thereby.

27. Any notices required to be given by this Lease Agreement or by applicable law may be given to (a) in the case of LANDLORD, at the address set forth in the first paragraph in this Lease Agreement or any other address of which TENANT has been notified, and (b) in the case of TENANT, at the address set forth in the first paragraph of this Lease Agreement. Notwithstanding the foregoing, notice by either party to the other shall be deemed adequate if given in any manner provided or recognized by law.

28. By booking with AirBNB, I have read all of the above policies, and I freely and expressly agree to, and will abide by, all of the terms and conditions stated within this written Rental Agreement.
