Our home is the largest, end unit at Regal Palms with New Carpets, Appliances and Bedding. Kitchen is well stocked along with all Modern Amenities and Appliances. Free Secured WiFi Internet, New Full size Washing Machine and Front Load Dryer. Strollers, pack-n-plays, high chair, booster seat, baby gate, linens and towels.

Regal Palms Resort and Spa is a gated community that is strictly controlled by electronic key access. The resort has 24 hour guest reception, a Business Center, Internet, Sundry Store, Arcade area, Swimming pavilion, full spa, tiki hut bar, sports lounge which feature large screened in TV’s, pool table, fitness center, hot tub, steam room, sauna, and showers.
The Restaurant in the Clubhouse serves meals, drinks, and appetizers to be served either inside the Clubhouse or outside on the veranda by the pool.

CLUB MEMBERSHIP There is an additional charge of $12.95 US per night per reservation (NOT PER GUEST) membership of the Regal Palms Sport & Social Club. Membership entitles free access to all the facilities of the Regal Palms Resort which includes full use of the Water Park, heated Swimming Pools, heated Water Slide, heated Lazy River, Hot Tubs , Game room, bar, Fitness Center, Sauna. Additional Discounts are available for 30+ day stay at selected times.
A request for a reservation and/or payment constitutes an agreement to the Terms and Conditions of this Rental Agreement.
"You", "Your", or "Guest" refers to the individual booking the reservation.
"Guest Party" refers to any persons invited into the townhouse by Guest.
"Owner" and "Townhouse Owner" refers to the owner of the townhouse you are renting.
"Management Company" refers to the Townhouse Owner's Property Manager.
"Resort" refers to the Regal Palms Resort & Spa.
1. Rental Policies
a. To book a reservation Guest must be at least 25 years of age.
b. Guest is legally responsible and liable for the actions of all members of Guest Party.
c. A person convicted of a felony involving violence to persons or property, a felony involving the sale of a controlled substance or a felony demonstrating moral turpitude, including, without limitation, sexual offenses are excluded from renting or residing in the townhouse.
d. The property is classified as a transient vacation rental. Guest and Guest Party must vacate the premises on the date of their scheduled departure.
e. Any breach of this Rental Agreement may result in the Guest, or members of Guest Party, being forcibly and permanently removed from the townhouse.
f. Guest is liable to Townhouse Owner for any damages suffered as a result of a breach of this Rental Agreement, including, but not limited to, lost revenue, cost to replace or repair damaged or stolen property, fines levied against Townhouse Owner, reasonable attorney's fees, and costs.
2. Townhouse Rental
a. The townhouse available through this Rental Agreement is located at Regal Palms at Highlands Reserve in Davenport, Florida.
b. The townhouse is self-catering. Guest will be required to purchase supplies. Maintenance of the townhouse is the responsibility of Guest during their stay.
c. Check-in begins at 4:00pm EST on the date of Guest arrival. Check-in time is not guaranteed.
d. Check-out is at 10:00am EST on the date of Guest departure.
3. Townhouse Restrictions
a. The townhouse has a maximum occupancy of 10 guests.
b. The townhouse has a NO smoking policy. A $250 fine is assessed for the violation of this policy.
c. The townhouse has a NO pet policy. A $250 fine is assessed for the violation of this policy. Service Animals, as defined by Federal and Florida State Law are exempt from this policy. Any misrepresentation of a Service Animal status shall result in a fine of $2,500.
4. Regal Palms Resort
a. Guest is required to pay any Resort Fee established by the Regal Palms Club.
b. The Resort and its facilities are privately owned. Townhouse Owner does not take any responsibility, and is not liable, for any goods or services that the Resort offers or provides. Furthermore, Townhouse Owner cannot be held liable for any goods or services discontinued by the Resort or that are temporarily unavailable. If any issue should arise with regards to the Resort or services that it provides, these issues must be addressed between Guest and Regal Palms Club Management.
5. Florida's Tropical Climate
a. Guest acknowledges and understands that Florida is a tropical climate and may contain many different insects. Townhouse Owner shall not be responsible or liable for any compensation as a result of insects in the townhouse or in the Resort.
6. Compliance with Laws, Rules and Regulations, and Rental Agreement.
a. Guest agrees to comply with State Law, Federal Law, and all Local Ordinances. Guest ensures that members of Guest Party are aware of Local Ordinances, State Law, and Federal Law.
b. Guest agrees to comply with all terms of the Rental Agreement. Guest ensures that members of Guest Party are informed of the terms of this Rental Agreement and their mandatory compliance.
b. Guest agrees to comply with all Rules and Regulations set by the Regal Palms Home Owners Association. Guest ensures that members of Guest Party are informed about the Rules and Regulations set forth by the Regal Palms Home Owners Association. Any allowance made by the Regal Palms Home Owners Association Rules and Regulations may be restricted by this Rental Agreement.
7. Payment Information
a. All reservations require a $200.00 deposit due within 2 days following confirmation of a reservation.
b. Full payment is due 60 days prior to arrival. Failure to make payment will result in the reservation being cancelled and any deposit forfeited.
c. Townhouse Owner has sole authority to select the forms of payment accepted.
d. Payment, except for the Resort Fee, will be made directly to Townhouse Owner.
8. Reservation Cancellation and Refunds
a. If Guest decides to cancel their reservation at any time during the rental period, for whatever reason, unless the townhouse is deemed uninhabitable, Guest does so at their own discretion and no refund will be given.
b. Under certain circumstances Townhouse Owner may need to cancel Guest reservation. In the event the Townhouse Owner cancels Guest reservation, Guest payments will be refunded in full. Townhouse Owner, shall not be liable for any damages resulting from the exercise of this provision, including, but not limited to, cost of travel, cost of accommodations, loss of revenue, or inconvenience.
c. No refunds are provided for reservations cancelled by Guest less than 60 days prior to scheduled arrival. A refund of the full balance received, is available if Guest cancels reservation more than 60 days prior to scheduled arrival. Townhouse Owner recommends the purchase of vacation insurance.
9. Fraud and Chargebacks
a. Guest ensures that they have legal authority to make payment using any account or instrument they make payment with.
b. Any Check, Money Order, or Cashier's Check, returned as fraudulent, canceled, or containing insufficient funds will be subject to a $35 fee.
c. Guest agrees to submit to the binding resolutions outlined in this Rental Agreement. Any Credit Card Chargeback, or other payment reversal, initiated by Guest will constitute a breach of this Rental Agreement and will be subject to a $100 fine plus any amount reversed.
10. Security Deposit
a. Guest is required to provide a Credit Card, at check-in, Resort for a security deposit.
b. The security deposit amount and policy shall be decided by Resort.
11. Property Damage and Theft
a. Guest is responsible and liable for any and all damage caused to the townhouse or Resort by Guest or members of Guest Party. This provision includes theft of property.
b. Any and all damage must be reported to Owner. Guest must allow Maintenance Company access to the townhouse, at all times, in order to repair any and all property damage.
a. Guest must notify Owner of any complaints immediately.
b. Townhouse Owner cannot be held responsible for any appliances, furnishings, inventory, goods or services,that are temporarily unavailable or inoperative.
c. Guest agrees to allow Maintenance Company access to the townhouse, at any time, to rectify any problem brought to its attention by Guest or Townhouse Owner.
d. Guest agrees that Townhouse Owner shall be the sole deciders if any compensation, such as a partial or full refund, shall be granted for a specific complaint related to the townhouse rental.
13. Right To Refuse Service
a. Townhouse Owner, and Regal Palms Home Owners Association, reserve the right to refuse service to any Guest, potential Guest, or member of Guest Party, at any time, for any reason.
b. Townhouse Owner shall not be liable for any damages suffered as a result of the exercise of this provision, including, but not limited to, loss of revenue, cost of travel, cost of accommodations, reasonable attorney's fees, and/or costs.
14. LIMITATION OF LIABILITY
a. TOWNHOUSE OWNER DOES NOT ACCEPT ANY LIABILITY WHATSOEVER FOR DEATH, PERSONAL INJURY, ACCIDENTS, LOSS, OR DAMAGES TO PERSONS OR PERSONAL EFFECTS, HOWEVER CAUSED. GUEST SHALL SOLELY BE LIABLE AND AGREES TO INDEMNIFY TOWNHOUSE OWNER AGAINST ANY CLAIM RESULTING FROM DEATH, PERSONAL INJURY, ACCIDENTS, LOSS, OR DAMAGES TO PERSONS OR PERSONAL EFFECTS, HOWEVER CAUSED, WITH REGARDS TO MEMBERS OF GUEST PARTY.
b. IN THE EVENT THE TOWNHOUSE IS DEEMED UNINHABITABLE BY GUEST, AND IS ALSO CONFIRMED TO BE UNINHABITABLE BY TOWNHOUSE OWNER, TOWNHOUSE OWNER IS ONLY LIABLE TO GUEST FOR THE TOTAL AMOUNT PAID FOR THE RENTAL. TOWNHOUSE OWNER SHALL NOT BE LIABLE FOR ANY DAMAGES SUFFERED AS A RESULT OF THIS FINDING, INCLUDING, BUT NOT LIMITED TO, DAMAGES TO PERSONS OR PERSONAL EFFECTS, LOSS OF REVENUE, COST OF TRAVEL, COST OF ACCOMMODATIONS, REASONABLE ATTORNEY'S FEES, AND/OR COST, REGARDLESS OF THE REASON FOR THE FINDING, INCLUDING, BUT NOT LIMITED TO, INFESTATIONS, INCLUDING BED BUGS, OR STRUCTURAL DEFECTS.
a. Guest agrees to indemnify and hold harmless Townhouse Owner from any liability, loss, damage, or cost incurred during, or as a result of, their occupancy, including reasonable attorney's fees and/or costs.
b. Guest agrees to indemnify Townhouse Owner from any claim brought forth by member of Guest Party.
16. Force Majeure
a. Townhouse Owner cannot accept liability where the contract is affected by force majeure.
b. In this Rental Agreement, force majeure is any event that Townhouse Owner could not, even with due care, foresee or avoid. These events include, but are not limited to, war, threat of war, riot, industrial dispute, natural disaster, fire, acts of God, acts of terrorism, adverse weather, government actions, technical problems with transportation, or other events outside of Townhouse Owner's control.
d. The party initiating a claim is solely responsible for all filing fees. Each party will bear their own legal fees, including attorney's fees and costs, except where this Rental Agreement provides for the recovery of reasonable attorney's fees and costs.
18. Other Terms
a. If any provision of this Rental Agreement shall be unlawful, void or unenforceable, for any reason, the other provisions, and any partially-enforceable provision, shall not be affected thereby and shall remain valid and enforceable to the maximum possible extent.
b. Guest agrees that this Rental Agreement may be assigned by Townhouse Owner, in their sole discretion, to a third party.
c. This Rental Agreement shall apply in addition to, and shall not be superseded by, any other written agreement between Townhouse Owner and Guest.
