Call for access to the property 1 hour prior arrival, available 24 hrs/day for emergencies, regular hours 6 am to 10 pm (10pm-6 am emergencies only). Please leave the house and all contents inventoried (owner photos) in the same condition it was received. If you don't know how to operate something, do not hesitate to ask. To enter the house, once booked, call owner for door code and pls text and call 30 minutes prior arrival to get keys to the gate. Please call host if you want to take the robot our of the pool, do not attempt to take it out, do not tamper with the pool equipment. The next door (ring bell) can be contacted in only case of emergency. We keep supplies of cell phone chargers, tooth paste, tooth brushes, deodorant, nail clippers, nail polish and nail remover, lotion, combs and brushes all new and wrapped for your convenience. Please leave a tip to cover for the items you may use in the medicine cabinet and pantry.

Please leave all items (pots, pans. dishes, glasses, other) in the same condition/and location where found. Linens can be pulled and left in the floor as we wash, steam and vacuum mattresses after each guest, please collect trash in canisters. Trash collector is to the east of the house. Please leave the house locked with the combination given to you when you leave, put in the code, wait for the green light to flash, lock the front door deadbolt prior leaving the house. Make sure you do NOT lock the lower knob, just lock the deadbolt in the front and backyard french door prior leaving. Make sure you turn off the kitchen gas knobs and all appliances are off. Please communicate with host in the event you are unsure how to operate anything and prior turning the fireplace on. The heater dial is in the wall behind the big plant. The internet password is under the modem which is on top of the refrigerator. I will give you the code when you call me 1 hour prior arrival. Please turn lights off when you leave. Please let host know if you need anything else, cereal, towels, milk, coffee, tea, bread, extra linens or blankets.

This rental agreement is entered into by and between the renter, hereinafter referred to as “TENANT(S)” & Maria Van Gelder & Martha Alomia, hereinafter referred to as “OWNERS” on this ___day of ______________, 20__ .
This agreement constitutes a contract between the TENANT(S) and OWNER. Please read this Vacation Rental Agreement thoroughly. Any money received by owner for occupancy of vacation property indicates the acceptance of the terms and conditions of this Vacation Rental Agreement. It is the responsibility of the TENANT(S) to be familiar with all policies within this agreement. This occupancy will be in the form of a Vacation Rental only and not constitute a permanent or primary residence or other tenancy. TERM OF AGREEMENT: The rental begins at 4 p.m. EST on (the “Check-in Date”) and ends at 11 a.m. EST on (the “Check-out Date”).

MAXIMUM OCCUPANCY: The maximum number of overnight guests for this property is limited to four (6) persons, according to the online booking and with appropriate guest fees applied at booking. Maximum occupancy for this property shall not exceed eight (8) persons at any time. If TENANT exceeds the maximum occupancy, TENANTS and any and all of their guests are subject to immediate removal and forfeiture of their security deposit and rental payment.
Occupancy Agreement
Overnight occupancy limited to two persons per bedroom (excluding children 6 and under). Daytime occupancy and pool guests limited to overnight occupants plus one additional person per bedroom up to a total of maximum eight (8) to include children and infants. Exceeding occupancy limits is considered a serious violation of this Rental Agreement and local law. Owner/Agent reserves the right to deny access or to have the premises vacated with no refund of monies should occupancy limit be exceeded. Daytime guests may trigger an additional maintenance fee for extra utilities, supplies, pool maintenance.

Parking Agreement
Parking is restricted to on-site spaces only. Park all vehicles in on-site garages, driveways, or other designated parking spaces. Parking on-street or outside of designated parking spaces is a violation of the terms and conditions of this agreement and may encroach owner’s space or HOA regulations. Owner/Agent reserves the right to deny access or to have the premises vacated with no refund of monies should parking restrictions be violated. Please list the information about all cars to be at the property. If the car is a rental, Guest may put ‘rental’ and provide the rental agency. There are no RV’s allowed, unless authorized in writing prior to occupancy. Oversized vehicles, larger than small sedan will not be parked inside the covered garaged, but on driveway.

POOL USE: Pool use is for guest use only any violation or use without pool guests being registered in writing with the owner, subject to pool fees, will be subject to immediate removal and forfeiture of their security deposit and rental payment. Guest must abide and sign the pool waiver form.

SMOKING: This is a NON SMOKING property. No smoking is allowed inside of the house//backyard (no cigarrette butts should be present at any time there either), whatsoever. Any TENANT or their guests not adhering to the No Smoking policy will result in automatic forfeiture of security deposit.

PETS: Pets are permitted only with prior approval of the owner and completion of a Pet Addendum to the agreement. No other pets or animals other than those specified on the Pet Addendum are allowed on the property at any time and violation of this policy will result in automatic forfeiture of security deposit.

RENTAL RULES: TENANT agrees to abide by the Rental Unit Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else TENANT permits on the property to abide by the following rules at all times while at the property.

DAMAGE/RESERVATION DEPOSIT: A damage/reservation deposit of $ 150.00 is required. This must be received within fifteen (15) days of booking the reservation. Deposit will be held in a non-interest bearing account. The damage/reservation deposit automatically converts to a security/damage deposit upon arrival. The security/damage deposit is NOT applied toward rent; however, it is fully refundable within (14) days of departure, provided the following provisions are met:
a) No damage is done to property or its contents, beyond normal wear and tear.
b) No charges are incurred due to contraband, pets, smoking, or collection of rents or services rendered during the stay.
c) No excessive cleaning required. All debris, rubbish and discards are placed in the dumpster and soiled dishes are cleaned.
d) No excessive utility charges are incurred.
e) No linens/towels are lost, stolen, or damaged. The Key (if applicable) Remote control/Garage opener are returned and home is left locked.
f) TENANT (or any of TENANT’S visitors), is not evicted by the owner (or representative of the owner), or the local law enforcement.
g) There are no missing items, all items in the house are inventoried and carry price tags with pictures as displayed at the house.
PAYMENT: An advance payment equal to 50% of the rental rate is required to confirm reservations. The advance payment will be applied toward the property rental price. Please make payments via website through the reservations site/web. Debit Card payments will be accepted via (SENSITIVE CONTENTS HIDDEN)
transfer for a small fee, charged by Airbnb or other vendor, which will be passed on to the renter. The advance payment is not a damage deposit. The BALANCE OF RENT is due thirty (30)days prior to your Check-In date. Tenant will incur in a 30$/day pool fee during pool season, no exceptions.

CANCELLATIONS: A sixty(60) day notice in writing is required for cancellation. Cancellations that are made less than thirty (30) days prior to the Check-In date but more than 2 weeks prior Check-In date, will forfeit half the damage/reservation deposit with refund of any additional pre-paid rental amount received or 50% of the total rental amount, whichever is less. Cancellations less than 2 weeks prior the Check-In date will receive no refund. Cancellations or changes that result in a shortened stay, or are made within thirty (30) days of the Check-in date, forfeit the full advance payment and damage/reservation deposit with refund of any additional pre-paid rental amount received. Cancellation or early departure does not warrant any refund of rent or deposit.

ADDITIONAL CHARGES: All "normal" utilities are included. In addition, Netflix, Hulu plus, Showtime, local channels; and wireless internet are included. TENANT will be charged:
• Wifi /Premium channels charges for any programing ordered during the rental period in addition to the provided.
• Excess dirty linens/towels left/missing linens/towels.
• HOA/NM/Bernalillo County imposed Fines/summons as a result of your actions.
• Missing/Any damage to the house or its contents.
• Excessive electricity/water/gas usage.

FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit, and/or rental money, and the party will not be permitted to check-in. No underage drinking allowed, no big parties or major events allowed.

GUEST/PARTIES/NOISE: The TENANT must supervise their guest(s) while on the premises. Noise in the house must be kept a reasonable level as not to cause a disturbance to the neighbors or general public. In no event may the maximum occupancy (as listed on this agreement) be exceeded without written consent. In the event occupancy is not disclosed with appropriate guest registration forms (owner written form and . If TENANT fails for vacate the premises at the end of the rental period prescribed in this agreement, TENANT shall be charged and liable to OWNER for $300 per day for every day past the date and time specified in this agreement. Airbnb guest web guest number disclosure (including but not limited to overnight, pool, party, dinning, family, visiting, etc.)

CLEANING: A cleaning fee of $65.00 is due with remaining rental payment fourteen (14) days prior to Check-In date. This constitutes 3 hours of cleaning service after the tenant’s departure. No cleaning service is provided during the tenants stay. Cleaning service charges in excess of$ 50.00dollars will be deducted from the Security Deposit for stays 4 days or over. Rates include a one-time linen-towel preparation, bed sheets setup, toilet paper, and paper towels. On departure leave all used beds stripped and unmade. The last day's towels are to be left in the bathrooms. All dinnerware, pots, pans, glasses should be cleaned and the dishwasher empty. Please discard used food from the cabinets and refrigerator that you brought or bought, unless prior arrangements have been made with owner. TENANT will be charged for excessive linens and/or unwashed dishes. Trash should be removed from the house and placed in the proper receptacle outside the house.

MAINTENANCE: It is expected that major systems in and around the house will break down from time to time such as air conditioning, washer, dryer, refrigerator, etc. OWNER will attempt to repair the problem as soon as possible upon notice by the TENANT. OWNER assumes no liability to TENANT if such should occur as all products have a useful life and break down occasionally. TENANT I no way will attempt to repair or fix yourself and advise the OWNER as soon as possible of any defects or malfunction. OWNER has the right to enter the premises to inspect damages and repair malfunctions and in event of emergency during rental period. OWNER will, if the emergency permits, inform TENANT prior entering the premises/ call/ring the bell/or leave a message prior entering the house.

ILLEGAL DRUGS/UNDERAGE DRINKING/VIOLENCE: Under no circumstances shall any illegal drugs be allowed on the property. TENANT understands that possession/use of any such substance is grounds for immediate eviction and forfeiture of payment. TENANT further waives any and all rights to recourse against the OWNER for enforcing this clause. This applies to UNDERAGE DRINKING, no underage drinking allowed. OWNER reserves the right to evict TENANT in event of a VIOLENT DISTURBANCE. OWNER will make use safety measures.

TENANT RESPONSIBITIES: All occupants are required to perform "Normal" household duties that include, but are not limited to:
• Garbage removal
• Cleaning of individual and guest dishes
• Notification to OWNER of any damages or problems with the property
• Locking of all doors when TENANT leaves the house unit. Please lock deadbolts in all doors, do
• not lock bottom locks. You have no key to bottom locks and you will be then locked out of the house.

SUBLETTING/ASSIGNING/OCCUPANCY: No subletting of premises. TENANT shall occupy/use the premises as a vacation rental only and not for any business, professional, unlawful or hazardous purpose.
REPAIRS: The OWNER must be notified immediately if you discover any item that needs attention.
END OF TERM: At the end of the term, the TENANT shall leave the premises clean and in good condition, remove all TENANT property, and pay for repair all unreasonable damages caused during their stay.

QUIET ENJOYMENT: TENANT and their guests agree not to violate quiet enjoyment and privacy of the surrounding neighbors. OWNER is not responsible for the actions of other property owners in the area, as I have no control over their actions.

WEATHER/ACTS OF GOD: OWNER is not responsible for any weather conditions or acts of god or nature that happen during TENANT’S stay on premises and no refunds will be made.

CONSTRUCTION: OWNER is not responsible for any actions of other property owners or homeowners’ association.

UNFORSCEEN CONDITIONS: If any unforeseen conditions or problems with the house arise prior to or during TENANTS stay, OWNER reserves the right to either refund TENANTS payment pro-rate or place TENANT in a comparable house with the same amenities, bedroom, etc. Such unforeseen conditions could be the following but are not limited to, hurricanes, storms, vandalism, flood, etc. OWNER assumes no responsibility for such unforeseen conditions.

ACCESS: TENANT agrees to allow access to the house and property to OWNER and his agents in the event of an emergency or for pool maintenance/repair prior 24 hour notice, and for non emergency reasons, upon 24 hours’ notice by telephone or in person. Agents include but are not limited to, plumbers, electricians, rental companies, pest inspection, etc. OWNER reserves the right to inspect the premises and house interior upon 24 hours’ notice to TENANT. TENANT agrees not to deny access. If TENANT refuses to allow access to OWNER or any agent designated by OWNER, the OWNER reserves the right to terminate the TENANTS vacation rental and TENANT will immediately vacate the premises upon demand by OWNER and will forfeit the rental payment.

SAFETY: TENANT acknowledges and agree that they are responsible for the safety of themselves, their guests and their children with respect to the pool, the deck areas, and the premises. TENANT acknowledges and agrees to hold harmless from any injuries to them or their guests. It is understood that there is no lifeguard and that supervision is their sole responsibility.

KEYS/CODES: Access to the property is provided by code and occasionally you may be given a key if the need arises or keyless code is malfunctioning. Codes are changed after each TENANT leaves. Codes may be changed daily, or in the event the property is found unlocked, suspected vandalism or at TENANT’S request. TENANT agrees to not share lock code with non-guests and not use the code to re-enter the house and return any set of keys (if applicable) after departure. All extra sets of keys and remote controls including the garage control should be left on the kitchen counter. Failure to return the set of keys or any remote after departure will result in a $10 key replacement fee and in the case of remotes, the cost to replace the remote from manufacturer plus any shipping/tax costs. This will be deducted from the security deposit for each key/remote needing replacement.

LAWS: State of New Mexico State Laws shall apply to all terms under this Agreement. Any dispute under this agreement shall be venued in Bernalillo County, New Mexico. It is expressly agreed and understood that this agreement shall not be recorded in the County Clerks office. Any legal fees for the recovery of funds based on this contract that the OWNER may incur, as a result of the breach of this contract by TENANT, will be the responsibility of the TENANT. Copies of government ID are required.

LIABILITY: TENANT may be responsible and liable to OWNER for damages in excess of the security deposit for any damage or loss caused by TENANT or its guest.

WRITTEN EXCEPTIONS: Any above mentioned policies exceptions must be approved in writing in advance.
DEPARTURE CHECKLIST: Upon departure, the Departure Checklist attached as Exhibit B must be completed and left on the kitchen counter. The security refund will be issued after the owner has received the checklist and inspected the property. In addition, please feel free to leave your comments or suggestions in our guest book.
BREACH OF AGREEMENT: Failure to comply with any of the foregoing clauses and overall rules established by OWNER will subject you to immediate removal from house and forfeiture of all rental payments and security deposits. If TENANT fails for vacate the premises at the end of the rental period
prescribed in this agreement, TENANT shall be charged and liable to OWNER for $300 per day for every day past the date and time specified in this agreement.

SURVIVAL: If any clause or term in this agreement is contrary to law, the remainder of the Agreement shall remain in full force.

After a hard day riding our motorcycles my brother and I arrived at Maria's , we're she was to greet us and her lovely mother. Not only was the house a delight to relax in the pool was amazing. Not only this, Maria kindly went to the pizza house to collect our supper she also grabbed a 12 pack of chilled beer for us to relax with. Fantastic.... Top place.... Thank you again

Ensure that check in time is approved & understood by you & the host. Due to miscommunication between us & the host, the house was not ready for us upon arrival. Details on wifi password/access was very helpful. Not our best experience.

My rules state to call/text one hour prior arrival to allow transportation from and to work to the house. I di dnot get a time of arrival but "midafternoon" and "we are here" so I could not accomodate. Check in time was 4 pm then and they arrived 330 pm. We agreed they will go to dinner and return in after 530 pm . I waited until 7 pm with no response via text or phone with me. I could not wait longer and left a text where to find the wifi password (under modem). This guest has an international number so text was the only way I could communicate and there is . a delay on text through airbnb. I got their text at 9pm and at that time we were already in bed. I responded at 915 from bed with modem instructions. I gave them a 30$ discount as I did not charge the normal fee . I hope this was useful. I will make same day reservation special guidelines so that I am not surprised with the last minute reservation while at work (1 hour away)

The house is spacious and comes with a stocked kitchen (including every type of kitchen utensil that you can think of), the beds are comfortable, the rooms are a nice size, and the pool is beautiful. There was a charcoal grill available but there wasn't any charcoal to cook with so I purchased a bag; I only used it once so I left the bag for the next renter. Other than that our stay was nice and Maria was very sweet. Thank you!

The location and pool are wonderful. The house is a great size for a family. There is room for improvement of the cleanliness of the home and garage and reasonableness of charges.

Les, my house is open to kids, but your kid started kicking the glass table and the lamp, actually he broke it and I feel you are upset because you had to deal with the damages, please understand that as a host I delivered a house in good shape and airbnb offers a good assurance that they will cover damages caused by guests, they just cannot be that quick, grill is going to be covered by them from the prior guest and the lamp your kid broke too. I did not leave a bad comment on your guest review about that and merely commented on the positive stuff. However.... I had the house ready at 2pm 2 hours earlier than 4pm published checkin time as per Les checkin request and got a text at 3 pm that they were at the museum of Natural history and they are going to come at 430pm so while idle for 230 hours waiting for them prior heading back to santa fe (1 hour trip) we brushed the pool and trimmed the yard, when they came we picked up the tools, and "lingered" for 5-10 minutes" . I have to remember not to be so "accomodating" next time. I will have a 4pm rule check in time from now on after this one guest. About the cereal it is FREE I may have to take off that and just offer NOTHING. THere were unopened boxes of cereal with a long year off expiration date. And about Garage, you had an oversized van and for an 11 passenger van, you need special arrangements. not usually in a standard sized house.

My best friend and I stayed in this home during our visit to ABQ for some R&R. Right off the bat, there was an unpleasant surprise after purchase - a message from Maria indicating that more fees were owed for the pool, wifi, and Showtime - the latter two of which were kindly "waived" (fortunate, since the wifi functioned about at the speed of dial-up and the Dish TV was pixelated and stilted). Why these "fees" were not just included in the price is beyond me. After all, there was not option to opt out. There was confusion about the check-in time, too. A day before check in, Maria indicated that we might be able to check in early. When I inquired about checking in early the next day, she didn't seem to know what I was talking about and referred me to the listing for the check-in time. In the end, we came an hour *after* check-in and she still acted as though we rushed her. Reception was bizarre and extended - we got a run-down of some of the temperamental things in the house (the garage door, the A/C, the microwave), a summary of all the past lousy renter, and multiple warnings about breaking rules or misusing things. Once Maria left, it quickly became clear that the house was not sufficiently cleaned by any objective standard. Some people wouldn't mind, but given that this is a vacation home, this seems unacceptable. There were sticky/greasy areas around the kitchen, to-go containers of half-eaten food and a half empty milk container as well as other questionable items in the fridge. The pantry was full of partially eaten boxes of kids' cereals. The tile floors were dirty enough to leave our feet black after walking around, the shower curtain liner in one bathroom had extensive mildew on it; the other shower featured both body hair and mildew. Thankfully, the bedrooms and pool seemed clean. Another major disappointment: Netflix didn't work (the night before we left, she offered to troubleshoot it), but the wifi was too slow to watch anything anyway and, as mentioned before, the satellite tv was also unwatchable, so there was really no option to relax in front of the (obscenely huge) screen at the end of the day. There was no real A/C in the bedrooms...only in the common areas. In truth, the pool is the only saving grace for this rental. The house is located in a quiet, safe neighborhood, but it's >20 minutes from anything of real interest...this really wasn't a problem for us but it's worth mentioning.

A picture is worth a thousand words. I found the bathrooms full of dirty humid towels in the floo rand some dried outside in the living room. Again, linens unpulled and trash all over the house, I could not paste this here unfortuately. I did not give her a comment as it would not conduce to anything positive, but gave her oral feedback and I believe her input is a reaction to that. We did not comment on this guest and she did leave the front and back doors open after she left, the bathrooms a mess, the linens unpulled, the refrigerator full of their food, the trashcans full. I had to pick up after them as if they were kids. It took a long time to clean the house and they used around 2 dozen towels, emptied the towels I had cleaned and washed for guests the whole week. I had to do laundry for 4 hours after they left or more… I even told them they can use my bicycles and my coolers and camping guear… and those are not sentimental of value but told them that if there is a flat they have to repair it. It is expected, The bycicles do not clutter the garage they are on the side of the house by the garage. Host: I'm gl ad, really gla d:) Below are my notes on our conversation: And, As far as the comments, I believe she did not mention anything in our communication or we would have gladly come back and fix or clean anything she wanted, In fact, she stood us u p after she wanted to check in at 9 am and there was someone in the house at the time. I explained I had to clean and we worked hard and hired another person to clean to get it ready for the guest 2 hours prior regular check in. I did not have to. I am going to adhere to a 4 pm rule of check in, no more concessions to any one. As far as the food, this guests had no business in commenting on food of mine, they rented the rooms and had no business eating my food, if I open that to them for free, they did not have to criticize, just eat the food they buy for themselves, and not others. As far as the cleaning is concerned, it was clean or they should have told me about it so I can fix it. Abour the internet, YES, I heard from this and the current guest, so I am changing carriers but the installation is not overnight They give appointments 2 weeks out. I'm sorry to say we are also disturbed to have found two condom boxes, one of which was empty. To say the least, it is extremely uncomfortable to see this in a vacation rental. I love to learn and books that teach me something, so when a friend was over, saw my books looking for a novela or a comedy or something to read, she said, well ah uh do you have any normal books? What do you mean I said, well something that is not business, law, real estate, computers or the like...
I aim to make this home a warm and peaceful place where some can find fun, others rest and others the convenience of being close to everything yet not too close to enjoy the quiet residential neighborhood.
