Hanu Kai "Breath of the Sea"

Tastefully designed by the Owners to create a carefree island lifestyle with beautiful sunsets year round, star gazing at its best and Whale Watching from about November through April each year. This home offers great privacy, peaceful living and remarkable view. The home is over 2300 SqFt, with a large covered lanai looking over the Pacific Ocean. Architect-designed construction was completed in December 2004. It is open floor plan with Brazilian Walnut (Ipe) floors throughout. There is a large walk in shower and deep soaking tub in the master bath along with an outdoor shower. The Master Suite is on the South end of the home and the additional two bedrooms are privately situated on the North end of the home with a shared bathroom in the hall. The South bedroom and North bedrooms are separated by large living area and open kitchen with a built in breakfast nook. The central living area has a high trussed ceiling and opens into a large kitchen with high-end appliances including a Viking stove. The kitchen offers a built-in breakfast area. Main Dining area faces the ocean with seating for 8. Adjacent to the living room is a media room which has surround sound, cable TV, DVD and CD player. Home is equipped with wireless, high speed internet.

The home is landscaped with mature palms and expansive lawn. For additional fun there is an outdoor regulation petanque court (similar to bocce or lawn bowling) made of crushed volcanic rock. The 1 acre property is often visited by local birds - saffron finches, java sparrows, francolin (similar to quail), and sometimes turkeys!

Kohala by the Sea is a gated community in a warm, dry climate. Wide open bright blue skies during the day and beautiful, bright night skies full of stars and planets. Positioned just 30-miles north of Kona on the beautiful Kohala Coast, the development encompasses approximately 77-acres, with a total of 73 home sites each on about one-acre. With exceptional ocean views, stunning mountains in the backdrop, and some of the most spectacular sunsets on the Big Island, Kohala by the Sea is a true Hawaiian haven for those looking to escape the hustle and bustle of the nearby resort communities, but have the many resort amenities nearby, including world-class golfing, shopping and dining. This is in addition to the area’s pristine white sand beaches and the seemingly endless recreational activities and water sports available up and down the coastline.

Home is Air Conditioned, however, any electric use above the baseline of $100 will be guest expense.

Nearby swimming and snorkeling are exceptional at Wailea Bay, Hapuna State Beach Park or the renowned Mauna Kea Beach.

Explore the frequent Farmer`s Markets in the historic Parker Ranch town of Waimea (also called Kamuela) all just a short drive away.

The Homeowner`s Association describes the neighborhood as, "Kohala By The Sea is one of North Kohala`s premiere gated communities with great ocean, mountain, Maui and year round sunset views. Just minutes from Kohala coast resorts, white sand beaches, golf and first class restaurants."

Hanu Kai is a monthly rental and cannot be rented for less than 30 days.

Hawaii Vacation Rentals - Terms And Conditions
Please read this Vacation Rental Lease Agreement thoroughly. Any monies received by Hawaii Vacation Rentals, Inc. for occupancy of Vacation property indicate the acceptance of the terms and conditions of this Vacation Rental Lease Agreement.
It is the responsibility of the guest(s) to be familiar with all policies within this agreement. This rental agreement is entered into by and between the renters hereinafter referred to as “Guest”, and Hawaii Vacation Rentals, Inc. (HVR Inc.) hereinafter referred to as “Agent” and or “HVR”.

1. CHECK-IN AND CHECK-OUT
Your home will be ready for you on your CHECK-IN DATE. CHECK-IN TIME is 3 PM. CHECK-OUT TIME is 11 AM. Often times our bookings are back to back so it is essential that you respect these times. It is extremely important that you adhere to these times unless special arrangements have been made. Last minute request for early check-in or late check-out will not be accepted unless arranged prior to arrival. Each option of Early Check In and Late Check Out is based on availability. The fee for each option will be assessed at a flat rate of 50% of the base nightly rate of the rental.

2. CHECK-OUT PROCEDURES
Upon checking out please:
- Leave the home neat and tidy. Please leave the home in the same condition as when you arrived.
- Lock all the doors and leave the keys on the kitchen counter.
- Close all windows and louvers.
- Take your trash to the disposal area. There will be a disposal fee of $35.00 if trash is left in the unit. If you are in a Condo, they provide dumpsters for your trash. For homes, the Puako Transfer Station is open: Sunday, Tuesday and Friday 8 AM to 4 PM. Dispose of all of your trash one of theses days closest to you leaving. We understand there may be a small amount of trash left because of the schedule of the transfer station.
- Wash all dishes.
- Strip the beds and leave dirty linens in a pile. Please do not leave damp or wet items in a pile.
- Turn off all lights, fans and air conditioning.
If you wish to book this property for the same dates next year, please notify our office (EMAIL HIDDEN) (PHONE NUMBER HIDDEN) prior to your departure.
We invite you to communicate any issues with your property right away. We will do our very best to rectify any situation as soon as possible. One way we are able to keep our properties in good repair is by guest feedback. We do not want you to have to deal with burnt out light bulbs or anything that is not in working order. 3. NON-LIABILITY/INDEMNITY OF OWNER OR HAWAII VACATION RENTALS
The owner of the property and Hawaii Vacation Rentals will not be liable to Guest or any other persons on the property for any damage or loss occasioned by any service provided by the owner or Hawaii Vacation Rentals under this Rental Agreement; or by electricity, plumbing, gas, water, air conditioning, sprinkler or other pipes and sewage systems, or the loss, interruption or stoppage thereof, or by the bursting, leaking, overowing or running over of any tank, washstand, closet, waste or other pipes in or the property, nor for any damage occasioned by water coming into the property from any source whatsoever, or for any damage or injury arising from any acts or neglect of the other occupants of, or any other persons on, the property or of any adjacent property, or of the public, unless such damage or loss results from a wanton and willful act of the owner or Hawaii Vacation Rentals or owner`s or Hawaii Vacation Rentals’ gross negligence. All property of Guest and the other occupants of, or any other persons on, the property shall be kept or stored at the risk of Guest only, and Guest shall hold the owner and Hawaii Vacation Rentals harmless from any claims arising out of damage to the same. In no event shall owner or Hawaii Vacation harmless from any claims arising out of damage to the same. In no event shall owner or Hawaii Vacation Rentals be liable to Guest or the other occupants of the property for any loss, damage or injury, or any claims or demands therefor, on account of any loss, damage or injury to any person or property, including any injury or loss to Guest, whether caused by the negligence of owner or Hawaii Vacation Rentals, or any one of them, or otherwise arising out of the use or occupancy of the property described in this Rental Agreement unless such loss, damage or injury shall result from a wanton and willful act of owner or Hawaii Vacation Rentals or owner`s or Hawaii Vacation Rentals’ gross negligence. Guest shall indemnify and save owner and Hawaii Vacation Rentals harmless against and from any and all claims, damages, costs and expenses, including reasonable attorney`s fees, arising from the use or occupancy of the property described in this Rental Agreement by Guest or others with the consent of Guest.
Please notify us immediately of any damage to the unit or grounds. Guest agrees to hold owners and agents free and clear of any liability for damage to self or property, resulting from accident or injury, or loss of enjoyment, due to power outages, rain, sun, ood, wind, surf, negligence, defective construction, re, theft, inoperable appliances, equipment, hot tub/spa, etc. The management will respond and attempt to repair or replace anything that may break down in your Vacation home as soon as possible. Please keep in mind that being on a remote island in paradise sometimes keeps us from getting parts and repairs completed as timely as you might on the mainland. There will be no refunds for such inconvenience.

4. ENERGY CONSERVATION
Please be energy conscious, by turning off lights, fans, air conditioning, TVs, radios, etc. when leaving the unit.

5. ADDITIONAL ELECTRIC
Guest is in agreement that any electrical usage over $150/month will be paid by Guest once owner has provided a copy of the Hawaiian Electric bill. All parties understand that some of this usage may not be billed prior to checkout.

6. LOST KEY REPLACEMENT
There is a $100.00 charge for replacement of lost keys and $100.00 for a garage door opener. If you lock yourself out of your property, there will be a $100.00 fee to send someone to open the property. We cannot guarantee immediate response.

7. MAID SERVICE
Your rental includes a cleaning fee for the cleaning prior to check-in on your CHECK-IN and a cleaning following the check-out on your CHECK-OUT DATE. If you would like additional maid service during your stay, please make arrangements with HVR prior to your arrival. Please contact Hawaii Vacation Rentals in advance of your booking to confirm both availability and current rates for any requested maid service to better ensure that maid service will be available to you during your stay.

8. MAXIMUM OCCUPANCY
The maximum number of people including children is specied as “Accommodates:” in the Rental Property Information. PARTIES OR EVENTS ARE NOT ALLOWED ON THE PROPERTY.

9. NOISE
Please keep in mind that you are in a very small and peaceful residential neighborhood. Noise carries over and near water. We ask that you and your children respect your neighbors` privacy, peace and quiet.

10. NON-SMOKING UNIT
This is a non-smoking rental. No smoking is allowed inside any of the buildings on the property. No cigarette butts in gravel or yard.

11. PESTS
Our homes are treated on a regular basis; however, pests are a normal part of life in the tropics. Please let us know right away if you have any issues. We will do our best to remedy.

12. RUBBISH
For renters in Puako and or Wailea Bay, we have no regular rubbish pick up in our neighborhoods so please take all of your trash and refuse to the Puako transfer station at the north end of Puako Beach Drive. Puako Transfer Station is open: Sunday, Tuesday and Friday from 8am to 4pm.
At the Condos or Town-homes, please take your trash to the designated disposal areas. You will be charged a service fee for trash removal, if rubbish is left at the property. All other Properties please dispose at the nearest Transfer Station, otherwise a removal fee will be charged.

13. SUPERVISION OF CHILDREN
We are pleased that so many families come to stay with us and would like to ask that special attention be given to your children while they are in unfamiliar surroundings and in such close proximity to the ocean and pools. DO NOT ALLOW SMALL CHILDREN TO PICK AND EAT ITEMS FROM THE YARD. THE GROUNDS ARE UNEVEN AND HAVE ROOTS PROTRUDING AND DIPS IN YARD. WATCH YOUR CHILDREN CAREFULLY WHEN ON DECKS OR STAIRS.

14. SUPPLIES
We will supply paper goods and soaps to get started. However, unlike a hotel, we are not responsible for replenishing your supplies beyond that.

15. TELEPHONE CALLS
There is no charge for local (Big Island) phone calls. Please charge all off-island telephone calls to your credit card or home/business phone. Many of our properties no longer have landlines so traveling with your cell phone is advised.

16. TRAFFIC
Please DRIVE SLOWLY in our neighborhoods. The speed limits are 10 mph to 25 mph and there are many children and adult pedestrians and bicyclists.

17. USE OF PROPERTY
You may use the home only as a place of vacation. You may not use it for any unlawful, improper or offensive purpose or illegal activity.

18. FURNITURE
Guests agree that if they re-arranged the furniture in the move they will move back the furniture to the original position or be charged $(PHONE NUMBER HIDDEN). BEACH TOWELS
There will be a $40.00 charge for each beach towel that is missing.

20. VALUABLES AND PERSONAL PROPERTY
Take normal precautions for Protection of your valuables. Understandably, we are not responsible for any losses.

21. USE OF CANDLES
We advise against the use of candles inside the property.

22. NO PETS ALLOWED

23. NEIGHBORHOOD CONSTRUCTION
We are not responsible for any construction noise or inconvenience that may occur during your stay. No refunds will be given.

24. HAWAII GENERAL EXCISE TAX
Hawaii general excise tax (4.16%) and transient accommodations taxes (9.25%) are added to all rent charges, tota(PHONE NUMBER HIDDEN). NEXT YEAR
We prefer to offer our guests the opportunity to reserve the property for the following year. If you wish to elect for this option to book this property for the same dates next year, please notify our office prior to your departure. If you do not re-book prior to your departure, we will assume that we may offer it to someone else for the following year.

IF ANY OF THE ABOVE RULES ARE VIOLATED, HAWAII VACATION RENTALS RESERVES THE RIGHT TO IMMEDIATELY EVICT RENTERS, RESULTING IN THE FORFEITURE OF ENTIRE RENTAL AND DEPOSIT AMOUNTS. ADDITIONALLY, ANY RELATED FINES ASSOCIATED WITH THESE VIOLATIONS WILL ALSO BE DEDUCTED FROM THESE AMOUNTS. GUESTS BOOKING THROUGH (URL HIDDEN) ACKNOWLEDGE THAT THEY HAVE READ, UNDERSTAND AND AGREE TO THE TERMS AND CONDITIONS OF THESE HOUSE RULES AND RESERVATION AGREEMENT, AND AGREE THAT THESE TERMS APPLY TO ALL OCCUPANTS RESPONSIBLE FOR THE RENTAL.
