The parties agree to the terms of this Short Term Rental Agreement, as evidenced by the signatures set forth below.

SHORT TERM RENTAL AGREEMENT

This “Short Term Rental Agreement” (the “Agreement”) is made by and between owners of Villa Corona Del Mar; and
________________________ (“Guest”) as of the date set forth on “Terms of Lease” item #9 of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

1.Tenant Promise:
Tenant represents that (s) he is an adult at least 25 years of age and will be present for the term of this Agreement. Any reservation made under false pretense will result in the immediate loss of deposit and rent and termination of this Agreement including eviction. Tenant fully understands that (s) he is responsible for all actions of family members and guests on the premises and will assure that they abide by the terms set forth in this Agreement. Further, Tenant shall not use or permit any objectionable noise or odor to escape; permit or create a nuisance or disturb the neighbors; or in any way injure the reputation of the property

3251 Fourth Ave (Upper One Bedroom Flat ONLY), Corona Del Mar, CA 92625.

3.Rental Party:
The rental party shall consist of Guest and the following persons:

4.PETS
Absolutely NO PETS allowed. If evidence of a pet is found, it will cause the forfeiture of deposit, rent, and immediate eviction.

5.Maximum Occupancy:
The maximum number of guests who effectively stay at the property is limited to 2- 4 People.
If you are having any gatherings for lunch and dinner with family and friends this number could naturally exceed. Please have Villa Corona Del Mar management to agree to the number of people attending your large gatherings.

6.Special Use of Property:
WE DO NOT ENTERTAIN EVENTS OR PARTIES IN ANYWAY:
Special Events are defined as any limited gathering, both in time and scope, of individuals greater than the legal occupancy for an intended purpose such as a wedding, family reunion, birthday celebration, etc.
The use of the Premises is restricted to use by you and your family, unless both parties agree in writing to occupancy by a non-family group.

The property is furnished and includes as per the list in “Rental Contents” attached as “Exhibit A”.

8.Rental Rules:
Guest agrees to abide by the “Rental Rules” attached as “Exhibit B” at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.

9.Term of the (website hidden) begins at 3.00 P.M PST on _____________ (Check-in Date) and ends at 10.00 A.M PST on _____________ (Checkout date).

Tenant shall vacate the premises upon termination of the agreement unless Villa Corona Del Mar management and Guest have extended this agreement in writing or signed a new agreement; all other terms and conditions of this agreement shall remain in full force and effect.

Please respect check in and checkout times specified in item #9 “Term of Lease”.
Extra hours past check out are $50/hr. up to 4 hours, then it is an extra whole night at the daily rates for that specific season. If the checkout time is past, we have the right to remove the guest belongings and secure it in our office for the guest pick up.

10.Rental Rates and Schedule of Payments:
Travelers pay 100% to book(URL HIDDEN)
a.“Security Deposit”: A Refundable “Security Deposit” of $500.00 US Dollars for short term stays (less than 30 days) is due at latest before check in date.

The “Security Deposit” is Refundable within 14 days of the Checkout date provided:
•No evidence of smoking inside the unit. This will forfeit the entire $500 security deposit in addition to any damages in result of that.
•The unit is left in the same condition it was found. If the premises appear dirty or damaged upon Check-in, Guest shall inform Homeowner immediately.
•Furniture is NOT re-arranged.
•No damage is done to unit or its contents.
•No changes to Audio Video setting that requires a service call by a technician ($75 per hour technician charge)
•No linens are lost or damaged.
•All rubbish and discards are placed in garbage cans, and soiled dishes are placed in the dishwasher and cleaned.
•Clean refrigerator. Please remove all foods and drinks.
•All keys are left in the lock box (if applicable) and unit is left locked. (Charge of $50 per missing key).
•No early check-in or late checkout.($50 per hour charge after 10.00 a.m. of the checkout day)
•All charges accrued during the stay are paid prior to departure.
•No charges are incurred due to contraband, pets or collection of rents or services rendered during the stay.
•The renter is not evicted by the owner or representative of the owner, the local law enforcement, or the security company employed by owner.
•Any intentional damages to the rental unit during your stay could forfeit the entire security deposit.


b.“Non-Refundable Insurance Protection Premium”: Home Owner will purchase an “Insurance Protection Plan for Short Term Tenancy” on your behalf.
The cost of this policy for a maximum benefit of $3000 damage during your short term stay is $89.00.
The guest is responsible for the premium payment (item “10 c” of the Short Term Rental Contract).
This Security Deposit Protection plan covers UN-INTENTIONAL damages to the rental unit interior that could occur during your stay, provided they are disclosed prior to check-out. The policy will pay a maximum benefit of $3,000.00. Any damages that exceed $3,000.00 will be charged to the credit card on file. Full details of the Security Deposit Protection coverage are contained in the Certificate of Insurance or Insurance Policy. By submitting payment for this plan, you authorize and request Villa Corona Del Mar to pay directly any amount payable under the terms and conditions of this Insurance Protection Policy. Please contact us immediately upon check in if you find any damages.

c.This agreement is set up for short term rentals ONLY (less than 30 days).
Long term stays (over 30 days) will be subject to California Association of Realtor rules and regulations and will be subject to additional security deposits.

d.“Inclusive Fees”: Rates include a one-time linen & towel setup. Amenity fees are included in the rental rate.
In case of any dysfunction in the equipment or appliances the owner will make its best effort to repair as speedy as possible; however failing in quick reparation will not be considered as a cause for rental deduction.


11.Cancellation:
Strict: 50% refund up until 1 week prior to arrival, except fees
If there is a natural disaster, no refunds will be given unless the state or local authorities order mandatory evacuations. The refund will be in line with the days of such mandatory evacuations. There will be NO REFUNDS in any event with any power or utility outage due to city of Newport Beach mandatory plans.

12.Access:
Guest shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.

13. Cleaning during your stay
If you require an additional cleaning during your stay we can provide you the contact information for a contract cleaning service.
You will need to directly deal with them and pay them separately from Villa Corona Del mar accounting. Villa Corona Del Mar UNDER NO CIRCUMSTANCES accepts any liability for any damages or loss arising from that service. Cost will depend on the service needed.

14.Accidents, Injuries or Illness:
The home is privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

15.Insurance:
We highly recommend all guests purchase travel insurance. If you wish to purchase travel insurance, go to (website hidden) for details and to purchase.

16.Breach of Contract:
Owner may terminate this Agreement upon the breach of any of the terms of this agreement or the Rental Rules agreement by Guest. Guest shall not be entitled to the return of any rental monies paid under the terms of this Agreement and shall vacate the Property immediately.


RENTAL RULES:

1.NOISE
RESPECT YOUR NEIGHBORS by keeping the volume of music and noise down.
In spite of neighborhood noise restriction by Newport Beach police department between the hours of 10 pm to 7 am; Villa Corona Del Mar management strictly forbids any loud or irritating conduct that may upset the peace of the others in the neighborhood (parties for instance) AT ANY HOUR OF THE DAY OF THE WEEK.
SHOULD GUESTS FAIL TO COMPLY, VILLA CORONA DEL MAR MANAGEMENT WILL RESERVE THE RIGHT TO DEMAND THAT THE GUEST VACATE THE VILLA IMMIDIETLY, IN WHICH CASE THE GUEST WAIVES ANY RIGHT TO REIMBURSEMENT FOR THE REMAINDER OF THE STAY.

2.PARKING
Vehicles are to be parked in designated carport areas only. Parking is limited to one vehicle.
Parking on the road is also permitted. Please respect city regulations and signage.
Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

3.SMOKING IS STRICTLY PROHIBITED

4.IF YOU ARE GOING TO THE BEACH:
WASH OFF SAND BEFORE ENTERING THE HOUSE. All Beaches provide showers (Cold and Hot).
CLEAN YOUR TOWELS AND CLOTHING FROM SAND, BEFORE ENTERING THE HOUSE.
DO NOT SIT ON THE FURNITURE WITH WET BATHING SUITS.

In order to dry clothes or bathing suits please use the clothes dryer. Hanging clothes on balcony or exterior railings is against the Villa Corona Delmar Management Rules as it detracts from the aesthetic beauty of the community.

6.FIRE PLACES/ GAS GRILL
DO NOT THROW ANY MATERIAL IN ANY OF THE FIREPLACES
DO NOT TRY TO USE WOOD LOGS IN ANY OF THE FIRE PLACES. They are not designed for that.

DO NOT LEAVE THE GAS GRILL ON WHEN NOT USED.
NO FIRE in any type “FIREPLACE” or “GAS GRILL” shall be LEFT UNATTENDED.
PLEASE TURN OFF ALL FIRES BEFORE GOING TO BED OR LEAVING THE HOUSE.
VIOLATION OF THIS PROVISION SHALL BE GROUNDS FOR EXPEDITED EVICTION.

7.OVEN
DO NOT USE THE OVEN’S SELF CLEANING MODE.
Using the self-cleaning mode requires special precautions, i.e. the stainless steel oven racks inside the oven needs to be removed prior to cleaning otherwise the high temperature will shatter the inner oven glass doors. Please do not attempt to clean the oven.

8.TOILETS
DO NOT FLUSH ANYTHING OTHER THAN TOILET PAPER.
No feminine products should be flushed at anytime. If it is found that any inappropriate object has been flushed and has clogged the system, you will be charged for the maintenance fee.

9.GARBAGE DISPOSER
DO NOT THROW ANY FOOD DOWN THE GARBAGE DISPOSER.
Excess food will clog the water hose. This may require a Maintenance Call and result in a Maintenance Fee.

10.DISHWASHER
DO NOT PLACE DISHES WITH FOOD PARTICLES INSID DISHWAHER.
Excess food will clog the water hose. This may require a Maintenance Call and result in a Maintenance Fee.

11.PROTECTIVE MATTRESS COVERS
DO NOT REMOVE protective Mattress covers.
All beddings are Tempur-Pedic all Memory Foam Mattresses and Pillows.
The protective covers will provide adequate protection and ensures that the warranty is not voided in case of spills.

12.(NEUTRAL PH) ALL PURPOSE CLEANER
DO NOT USE commercial brand all-purpose cleaners on kitchen Granite counter-tops, Patio table or any of the Marble counter-tops.
Please use either WATER or the ALL PURPOSE CLEANER provided to you located in the kitchen cabinet below the sink.
This cleaner is disinfectant and can be used for all surfaces while it is safe for precious stones.

DO NOT CHANGE THE VIDEO / AUDIO CABLE CONNECTION SETUP behind the entertainment cabinet as it might result in a technician service call. If you have questions please refer to the OPERATIONS MANUAL or you may call me anytime to help you out.

14.RESPECT OUR PROPERTY.
This is a Luxury Rental Villa and many fixtures and appliances are very expensive to replace.
PLEASE KEEP ALL DÉCOR AND ARTS UNTOUCHED.
PLEASE DO NOT RE-ARRANGE FURNITURE.
We suggest you bring beach towels. WE DO NOT PERMIT TOWELS TO BE TAKEN FROM THE UNIT.
PLEASE USE APPLIANCES FOR THEIR INTENDED USES.
