**Payment Info because many people ask: "Submit a Booking" means you pay the full amount now. I do not get paid until after your arrival. There are no cash transactions and with Airbnb you cannot put down a deposit. Also, the security deposit is not collected upfront. Of course we would like you to enjoy your vacation and not worry about to many rules, and thus the overarching rule is treat Sweet Carolyn Beach House how you would like your house to be treated. We have, however, done short-term leasing for awhile so we do need to include that by booking this property you agree to the following short-term rental agreement:
Sweet Carolyn Beach House Rental Agreement
This Rental Agreement (hereinafter “Agreement") constitutes a contract between the Airbnb or the (SENSITIVE CONTENTS HIDDEN) reserved and named Guests (hereinafter “Guests") as well as any and all invited guests and DOJOCO, L.L.C. (hereinafter “Company") at Sweet Carolyn Beach House, 121 E Carolyn, South Padre Island, 78597 (hereinafter “Property"). By reserving and staying at the Property, Guests are accepting all terms and conditions of this Agreement set out herein. Failure to abide by the rules, terms, conditions of this Agreement will result in forfeiture of Guests security deposit, rental money and fees and/or eviction from the premises, which shall be determined at Company's sole discretion.
Occupancy. The occupancy will be in the form of a Vacation/Short Term Rental only and not constitute a permanent or primary residence or other tenancy. The Guests agree to vacate the premises at the expiration time and date of this agreement. The Guests agree to forfeit and waive all rights to security deposit if they fail to vacate the premises upon termination of the rental period and are also responsible for any additional cost or damages occurred by said breach unless written approval to extend their rental term is agreed to by the Company.
Security Deposit. Airbnb does not charge a security deposit. Instead, Airbnb makes sure the "security deposit" listed on the site is available on the card at the time of booking. Thus, by booking on Airbnb Guests are accepting the terms and conditions of this Agreement. The security deposit is NOT applied toward rent, but will be used if damage related to the Property occurs. The Company will notify the Guests and Airbnb regarding damages and Airbnb will then use the Guests card to cover the damages. If damages exceed the security deposit amount, Guests will be responsible for charges in excess of the security deposit. Payment for the extra charges will be requested by email within 30 days of departure and payment must be made by Guests within 10 days of receipt of email. Failure to provide payment for the extra charges will result in a civil lawsuit filed against Guests for extra charges plus attorney's fees.
Check¬-In/Check-¬Out Times. Check-¬in time is after 3:00 p.m. Check-¬out time is at 10:00 a.m. In the event of a late departure not previously approved by Company, Guests will be charged an additional night's rent. Do not attempt to enter the unit prior to Guests check-in time even if it looks like the cleaning crew is finished. Check-out includes the entire Property and pool side area. Upon check out, if Guests are going to stay on the island the Guests must remove all personal belongings and vehicles from the Property for the next Guests.
Guests and Maximum Occupancy. ¬ THERE ARE NO UNREGISTERED GUESTS ALLOWED ON THE PROPERTY. ¬ Guests reservation is confirmed for the number of Guests listed. The Guests are subject to immediate eviction without benefit of any refunds of rental fees or security deposit if more Guests than listed are present on the Property. The persons whose name is on the rental agreement of Airbnb or (SENSITIVE CONTENTS HIDDEN) must be Guests or related to Guests. Subletting is not allowed. At least one person over the age of 25 years old must be a guest staying at the Property when other younger Guests are staying at the Property.
Furnishings. Furnishings are subject to change without notice. Furniture, bedding, mattress pads, kitchen equipment, utensils or any other Property supplied with the rental Property must not be moved or taken out. Loss of these items, as well as damage to the Property or furnishings in excess of normal wear will result in Guests security deposit being kept. The Property is inspected by Company staff at the conclusion of Guests stay. All contents of the home are the Property of the Company. If something should break, Guests must notify Company immediately to assess the damage. Guests are not permitted to alter any Property infrastructure, which includes but is not limited to the wiring of any television, sprinkler system control panels, electrical control panels, plumbing, home theatre, gaming equipment or the like.
Trash. Guests shall dispose of all waste material generated during the rental period in a lawful manner and put the trash in the assigned bins or trash cans provided by Company. Excess trash that the cleaning crew has to dispose of will be considered damages and withheld from security deposit.
Pets. Pets (DOGS ONLY – NO CATS ALLOWED) are allowed with the express approval of the Company and only after the payment of an additional payment of $19 per pet and a $300 pet deposit. Any Guests who bring unregistered pets will face immediate eviction and forfeiture of rental payments and security deposit. Guests bringing pets on the Property must comply with the following pet rules:
All pets must be up to date on rabies vaccinations and all other required vaccinations.
Pets must be leashed at all times when out of the house.
Guests is responsible for all pet refuse.
Pets are to be treated with a topical flea and tick repellant at least three (3) days prior to arrival. Fleas and ticks are very rampant in this area and can
cause harmful/fatal illness to humans and pets.
Pets are not allowed on the furniture or in the pool. Any evidence of pets on the furniture or the pool will result in the forfeiture of the entire pet deposit and may result in the forfeiture of the security deposit.
Excessive noise by any pets which disturb neighbors may result in eviction from the Property.
Pets shall not be left unattended for any length of time, indoors or outdoors.
Pets shall not be left unattended on the balcony or porch.
The Company assumes no responsibility for illness or injury that may occur on the Property to humans or pets.
Guests are solely responsible for their pets while on the Property. Failure to comply will result in forfeiture of the security deposit, pet deposit, damage charges and possible eviction from the Property.
Parking. Guests are allowed to use the driveway and garage to park a total of 4 cars. Tents, campers, trailers, or motor homes are not permitted on the Property unless prior approval from Company. Company is not responsible for any fees associated with towing or disablement of any vehicles owned or operated by Guests on the Property. Once Guests have checked out of the Property Guests must also remove Guests car from Property so the next Guests will be able to park. Parking on the grass is not permitted and may result in loss of security deposit and any charges incurred in replacing landscaping and/or sprinkler system repair.
No Smoking. There is no smoking allowed inside the house, no exceptions. Smoking is allowed outside as long as all cigarette butts are picked up and discarded by Guests upon check out. Upon check-out, if smoke smells are detected inside the house, the security deposit will be forfeited. Extra fees will be charged to remove the smoke smell from the house. Upon check-out, if cigarette butts are found on Property, the security deposit will be forfeited.
Pool. FRONT GATE MUST REMAIN CLOSED AT ALL TIMES (this is a city ordinance). Please rinse sand off in the outdoor shower before entering pool. No glass is permitted in the pool area including the concrete entertaining area next to the pool. THERE IS NO LIFEGUARD ON DUTY. Guests swim at their own risk and any children under 12 must be supervised by an adult. Any tampering with pool equipment or settings will result in loss of security deposit and any additional costs required getting the pool up to standard. Pets are NOT allowed in the pool. Guests will leave pool area in clean condition, by throwing away trash and cleaning up after themselves.
Lost or Stolen Property. Company disclaims all liability and does not accept any responsibility for lost or stolen articles of Guests.
Excessive Cleaning. Excessive cleaning fees will be deducted from the security deposit when the Property is left in an extremely dirty condition. This includes the pool area. The decision to charge this fee is at the sole discretion of the Company.
Illegal Activities. Any Guests arrested for any illegal activity will be subject to immediate eviction without benefit of any refund of rental fees or security deposit.
Noise Violations. Guests will not interfere with the peaceful enjoyment of the neighbors. Guests understand that domestic disturbances not only infringe on the neighbors' peaceful enjoyment of the Property, but are also in default of this Agreement. Any noise complaints that result in the police coming to the house will result in loss of security deposit, all rental fees, and immediate eviction from the premises.
No Fireworks. No fireworks are permitted in or around the house.
Entry of Property. Company or its representatives may enter the Property at any time, without notice, for the purposes of protection, and/or maintenance of the Property.
Weather. There shall be no refunds of rents due to shortened stays or ruined expectations because of weather conditions
Agreement to Comply with all Rental Regulations. Guests must comply with all of the Rental Regulations Failure to comply with the Rental Regulations and any reservations made under false pretenses may result in loss of all Guests payments made to Company and possible removal of Guests from the rental Property, in addition to all other remedies available to Company. If Guests violate any of the conditions of this Agreement, Company may enter the rental Property and Guests agree to vacate the rental Property immediately upon the request of Company and forfeit all rent paid.
Assumed Risks for the Swimming Pool. Guests assume all risks related to the use of the Swimming Pool including any illness or injury.
Mechanical Failures. Company cannot guarantee against mechanical failure of electrical service, stopped plumbing, water supply, heating, audio visual equipment, computers or internet access, television or appliances. Please report any inoperative equipment to Company immediately. Company will make every reasonable effort to have repairs done quickly and efficiently. No refunds or rent reductions will be made due to failure of such items.
Acts of God. Company shall not be liable or deemed in default under this Agreement for any failure to perform or delay in performing any of its obligations due to or arising out of any act not within the Company's direct control, including, without limitation, acts of God.
Indemnification and Hold Harmless. Guests, individually and on behalf of all other Guests and invitees to the Property, agree to and do hereby indemnify and hold harmless the Company, its employees, agents, Property owners, maintenance personnel, representatives and assigns (“Company Representatives"), from any and all claims, liability, including but not limited to injury to person or persons upon the Property from any cause whatsoever. This full indemnification includes and is not limited to any and all suits, injury, costs, losses, action, court cost, attorney fees, penalties and damages of any kind, however caused (except for Company's recklessness or intentional misconduct) and includes any expenses arising from or related thereto; from the Guests rental, use and enjoyment of the Property under this Agreement. Except for Company's recklessness or intentional misconduct, the Company Representatives shall not be liable for any claims, liabilities, or expenses relating to this Agreement, for an amount not to exceed the Guest's total/aggregate rental fees paid to Company for Guest's occupancy of the Property (excluding taxes and service fees). Company Representatives shall not be personally liable, in any manner whatsoever, for any judgment or deficiency resulting from this Agreement. Guest hereby waives all claims against Company Representatives for consequential, special, or punitively damages. The foregoing terms of this section constitute the Guest's sole and exclusive remedies.
Governing Law; Venue. This Agreement and all transactions contemplated by this Agreement shall be governed by, and construed and enforced in accordance with the laws of the State of Texas. Any civil action or legal proceeding arising out of or relating to this Agreement shall be brought in the courts of record of the State of Texas in Cameron County.
Entire Agreement. This Agreement represents the entire understanding and agreement between Guests and the Company with respect to the subject matter of this Agreement, and supersedes all other negotiations, understandings and representations (if any) made by and between such parties.
