Landlord, Kim Dennis and Tenant; WITNESSTH, that the LANDLORD hereby leases to the TENANT, and TENANT leases from landlord, the premises located at: 522 East Mountain Road Trail Creek Unit 10, Killington, VT 05751. The TENANT acknowledges that Occupancy for said property is for 10. If at any time the tenant exceeds said amount then it is grounds to evict after 1st warning. You have paid for 6 in the unit.
This lease shall begin on arrival at 5pm, an earlier check-in may be available. Please contact me three days prior to the rental start date, if you need to check-in at an earlier time. The lease shall end departure at 10:30 AM failure to vacate the premises by the aforementioned time is a violation of this lease and a charge will be assessed depending upon when you vacate the property; unless prior arrangements have been agreed to and stated above. Holdover rental rate will be at the rate of $1000.00 per day plus tax (if you do not let me know ahead of time that you wish to extend your rental and refuse to leave).
The TENANT will pay total as stated on airbnb to be secured by personal check plus a security deposit of also $500 by check; all linens for the beds, towels, washcloths, starter paper products), all taxes, cleaning upon departure, and service by my concierge for key pick-up/drop off and handling of any issues/concerns or emergencies. Please note there is not daily cleaning service for this rental. The rental will be cleaned and provisioned as stated above upon arrival and cleaned upon departure. Trash should be removed frequently, and the dumpsters are located in the garage area of the main parking lot behind the stockade fence.
The LANDLORD hereby notifies the TENANT that the agency below is the authorized to receive notice of violations of law and to accept service of process on behalf of the OWNER and further that the Trail Creek Condos/Matt Dutko shall act as local Killington concierge manager during this rental providing check-in/out including delivery of the keys for the property, as well as providing any emergency services on behalf of the landlord during the term of this lease. The undersigned parties hereby agree as follows:
1.No animals, birds, or pets of any description shall be kept in or upon the leased premises, this is a violation of the contract with the association. (Only owners are permitted to have pets on the premises per Condominium regulations.)
2.The TENANT will be responsible for all damages or breakage and/or loss to the premises, except normal wear which may result from occupancy.
3.The TENANT shall leave the house in a clean and orderly condition.
4.If the TENANT defaults and/or otherwise fails to comply as regards to any item in this lease, the TENANT agrees to vacate said premises upon receipt of proper notification from the LANDLORD and/or the above mentioned local agent (The Killington Group) and forfeit all remaining rental monies.
5.The TENANT will be in violation of this lease if state or local police, or other law enforcement officials, are called to the premises for noise complaint, or any civil or criminal violation.
6.The TENANT agrees to allow the LANDLORD or his agent to enter and view the premises with reasonable notice to the tenant:
a.to inspect the premises
b.to make repairs thereto
c.pursuant to a Court Order, and
d.to protect the premises if it appears that the said premises have been abandoned by Tenant
7. The LANDLORD and the TENANT agree that should the premises be destroyed by fire or other casualty so as to become unfit
for human habitation that the lease shall thereby be ended, with refund to the TENANT for any rent item unused prorata.
8. The LANDLORD agrees to keep his property in good repair and to supply fixtures and households furnishings, equipment or
other personal property only as represented at the time of the rental.
9. The purpose of this lease is a vacation rental. LANDLORD will not be responsible for any weather, natural disaster or item
out of their control as far as refunds or partial refunds are concerned

11. We believe that our pictures are extremely representative of the unit you will occupy. 12. Smoking is not allowed inside the premises (If you do smoke in the condo there will be a $900 charge for smoke remediation)
13. Payment is due as noted above on page one. In case of cancellation, the rental monies are not refundable unless,
after reasonable efforts on the part of the landlord to re-book the cancelled date(s), the unit is in fact re-booked, in
which case the refund shall be the monies received less 1) a $100 booking fee and 2) the difference, if any,
between the original rental price minus the re-booked rental price. Reasonable efforts shall mean the re-listing
of the unit on the same listing site or service as the tenant used to book the unit.
14. A $700 security deposit is required. The unit is expected to be left in a condition for which there are no broken, damaged or items taken from the unit. Also if there is additional cleaning necessary above the "normal" cleaning you will be charged $35 an hour for the cleaner. Deductions from the security deposit will include but are not be limited to: broken or damage items, items taken from the unit or extra cleaning above a "normal" clean. I also may collect from you above and beyond the $00 security deposit for anything costing above $00 security deposit. If there is damage from a previous guest it must be reported within 4 hours of arrival.
15.Venue: If any controversy or claim rises out of this rental agreement or the breach thereof the rental agreement shall be governed by and construed and in accordance with the internal laws of The State of Florida (Miami Dade County). and the parties hereto agree that any legal action in connection herewith by either landlord or TENNANT shall be venued in The State of Florida (Miami Dade County).

I do require a $500 security deposit that is paid by check and then refunded based on unit condition
absolutely no smoking in the unit if you do there will be an $800 charge for this violation. No pets as per the association this is a legal liability rule with the association. Quiet time is 10pm to 7AM no loud noises those hours. A rental agreement must be signed. I do not allow for any holidays to be booked on line with AIRBNB due to their lax cancelation procedures and extenuating circumstances rules. I also do not allow prime time weekends for this same reason unless it is a week or less prior to arrival.
